R-99- 3 dg A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING THE COMPREHENSIVE PLAN TO RESTORE THE EVERGLADES (RESTUDY); DIRECTING THE CITY CLERK TO SEND A COPY OF THIS RESOLUTION TO THE BROWARD COUNTY LEGISLATIVE DELEGATION AND THE BROWARD COUNTY BOARD OF COMMISSIONERS FOR CONSIDERATION DURING THE 2000 LEGISLATIVE SESSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Everglades is a vital part of Florida's heritage and is recognized nationally and internationally as one of the world's most significant but imperiled ecosystems; and WHEREAS, the economic and environmental sustainability of South Florida is dependent upon a healthy Everglades ecosystem; and WHEREAS, the State of Florida's economic health is dependent upon finding a balance in meeting the needs of the urban, agricultural and natural areas; and WHEREAS, adequate water supplies for five million residents are dependent upon restoration of the Everglades; and WHEREAS, pursuant to the Water Resources Development Act (WRDA), federal, state and local governments have devoted great amounts of money, time and energy to developing a Comprehensive Plan to Restore the Everglades, also known as the Restudy; and WHEREAS, the Restudy will improve South Florida's natural resources, enhance water supply, enrich the quality of life and maintain the economy and is the key to a sustainable South Florida; and Temp. Reso # 8820 - November 2, 1999 Page 2 WHEREAS, components of the Restudy provide specific benefits to Broward County residents such as a buffer between the urban areas and the Everglades, stormwater treatment areas to clean up pollution, reservoirs to enhance future water supply demands and the restoration of Water Conservation Areas in western Broward County; and WHEREAS, the Restudy is expected to cost eight billion dollars and the Water Resources Development Act mandates a 50/50 cost sharing between the State of Florida and Congress; and WHEREAS, the State of Florida share is estimated to be $200 million per year for twenty years; and WHEREAS, pursuant to the WRDA of 1996, the Restudy was presented to Congress on July 1, 1999; and WHEREAS, the implementation of the Restudy is at a decisive point where State legislation is a key to moving restoration forward; and WHEREAS, the Governor of the State of Florida recently announced that State legislation intended to fund and implement the Restudy would henceforth be entitled the Everglades Restoration Act; and WHEREAS, the upcoming Florida Legislature is expected to adopt legislation to meet the State's financial responsibility to fund the Everglades Restoration Act, a decision that will significantly impact the taxpayers and environment of South Florida for decades; and WHEREAS, whatever portion of the $200 million per year that the State of Florida does not commit to through legislation, South Florida taxpayers will be expected to pay; and 1 Temp. Reso # 8820 - November 2, 1999 Page 3 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to support the Comprehensive Plan to Restore the Everglades (Restudy). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The City Commission of the City of Tamarac supports the Comprehensive Plan to Restore the Everglades (Restudy) as a means towards enhancing future water needs. Section 3: The City Clerk is directed to send a copy of this resolution to the Broward County Legislative Delegation and the Broward County Board of Commissioners for consideration during the 2000 Florida Legislative Session. Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part of application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution.
