R-99- 3aq A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS TO REFUND PERFORMANCE BONDS PAID TO THE CITY BY HESS/FINA OIL IN THE AMOUNT OF $1,500.00 AND BY WOODLANDS COUNTRY CLUB IN THE AMOUNT OF $2,830.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac requires the person, developer, owner contractor or subcontractor who applies for a building permit to furnish to the City a good and sufficient bond; and WHEREAS, the contractor, subcontractor or other person having obtained a permit is responsible for the project until such work is approved by the City through its designated agent, City Engineer, Director of Utilities and Director of Community Development; and WHEREAS, Hess/Fins Oil was the developer for a project which required a performance bond for well removal, paving and drainage and landscaping in the amount of $1,500.00, and Woodlands Country Club was the developer for a project which required a performance bond for a water system tap, valve, and four inch D.I.P. service line to meter in the amount of $2,830.00; and Temp. Reso. #8776 September 17, 1999 Page 2 WHEREAS, Hess/Fina Oil has completed their project and corrected all deficiencies, and Woodlands Country Club has completed their project and corrected all deficiencies, and the City through its designated agent, City Engineer, Director of Utilities and Director of Community Development has no record of outstanding issues for these projects which would prohibit the release of said performance bonds; and WHEREAS, Hess/Fina Oil has requested the refund of their performance bond and Woodlands Country Club has requested the refund of their performance bond; and WHEREAS, the performance bonds are in the form of cash; and WHEREAS, the City Manager and Assistant City Manager/Interim Director of Finance recommend the refund of these performance bonds; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to refund the performance bond payments. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials are hereby authorized to refund the performance bond payment paid to the City by Hess/Fina Oil in the amount of $1,500.00 and to refund the performance bond paid to the City by Woodlands Country Club in the amount of $2,830.00 after the City receives the signed and notarized Indemnification, Hold Harmless and Release Form for these projects. 1 1 1 Temp. Reso. #8776 September 17, 1999 Page 3 SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
