Reso. #8835, November 12, 1999 1 Revision #1, December 13, 1999 Revision #2, December 14, 1999 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 99- 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON -AD VALOREM SPECIAL ASSESSMENTS FOR THE NORTH SECTION 7 ASSESSMENT LEVIED WITHIN THE NORTH HALF OF LAND SECTION 7 OF THE CITY; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida, through the adoption of Resolution No. R-99-312, Resolution No. R-99-251, and Resolution No. R-99- 189 created and established the North Section 7 Assessment Area, established the maximum amount of the annual Assessment for each Tax Parcel (as such terms are defined in Resolution R-99-189, the "Initial Assessment Resolution"); imposed Assessments against property within the North Section 7 Assessment Area, approved the Assessment Roll, and provided for the collection of the Assessments; and WHEREAS, the Commission intends to use the uniform method for collecting the non -ad valorem special assessment known as the North Section 7 Assessment for the cost of providing water and sewer to property within the North Half of Land Section 7, as authorized by section 197.3632, Florida Statutes, as amended, because this method will allow such special assessment to be collected annually commencing in November 2000, in the same manner as provided for ad valorem taxes; and Temp. Reso. #8835, November 12, 1999 2 Revision #1, December 13, 1999 Revision #2, December 14, 1999 WHEREAS, the Commission held a duly advertised public hearing prior to the adoption of this Resolution, proof of publication of such hearing being attached hereto as Exhibit A; and WHEREAS, the Director of Utilities recommends that the City Commission authorize the use of the uniform method of collecting Non -Ad Valorem Special Assessments for the North Section 7 Assessment; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to use the uniform method of collecting Non -Ad Valorem Special Assessments for the North Section 7 Assessment Area. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AS FOLLOWS: SECTION 1. The forgoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2. Commencing with the Fiscal Year beginning on October 1, 2000, and with the tax statement mailed for such Fiscal Year, the City intends to use the uniform method of collecting non -ad valorem assessments authorized in section 197.3632, Florida Statutes, as amended, for collecting non -ad valorem assessments, specifically the North Section 7 Assessment created and established for property within the North Half of Land Section 7. SECTION 3. The City hereby determines that the levy of the assessments is needed to fund the cost of water and sewer within the incorporated area of the City. SECTION 4. Upon adoption, the City Clerk is hereby directed to send a copy 1 Temp. Reso. #8835, November 12, 1999 3 Revision #1, December 13, 1999 Revision #2, December 14, 1999 of this Resolution by United States mail to the Florida Department of Revenue, the Broward County Department of Revenue Collection, and the Broward County Property Appraiser by January 10, 2000. SECTION 5. All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7. This Resolution shall take effect immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 22nd day of December, 1999.
