RESOLUTION NO. R-99- q0'
A RESOLUTION OF THE CITY
COMMISSION OF THE CITY OF TAMARAC,
FLORIDA, EXEMPTING THE PURCHASE OF
THE WEISZ PROPERTY LOCATED IN THE
VICINITY OF NW 67T" STREET,
PURCHASED PURSUANT TO RESOLUTION
NO. R-97-292, FROM THE APPRAISAL
REQUIREMENTS OF F.S. §166.045;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City purchased certain real property pursuant to Resolution No.
R-97-292, attached hereto as Exhibit 1, for a purchase price of Sixty -thousand Three
Hundred Fifty-eight Dollars and Twenty-five Cents ($60,358.25); and
WHEREAS, F.S. §166.045(1)(b) permits a municipality's governing body to, by
ordinary vote, exempt a purchase of real property in an amount of One Hundred Thousand
Dollars ($100,000) or less from the requirement for an appraisal; and
WHEREAS, the City Commission approved the purchase without requiring an
appraisal; and
WHEREAS, the City's auditor has requested that a specific resolution be acted
upon by the City Commission exempting the real property from the requirement for an

appraisal, consistent with F.S. §166.045; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to provide the auditor
with a resolution clearly exempting the real property purchased by the City from the
requirement for an appraisal as set forth in F.S. §166.045.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and is hereby made a specific part of this Resolution.
SECTION 2: The Weisz property located in the vicinity of 67" Street
purchased pursuant to Resolution No. R-97-292 is exempt from the appraisal requirements
of F.S. §166.045(1)(b), consistent with that statutory provision; and
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
