RESOLUTION NO. R-99- �
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, TO AMEND
THE LOCATION OF OPENINGS IN NON -
VEHICULAR LIMITED ACCESS LINES (NVAL)
ON NW 21 AVENUE AND PROSPECT ROAD;
SPECIFICALLY LOTS 1 AND 2 OF THE
"GOLFVIEW PLAZA" PLAT, ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT
BOOK 121, PAGE 3 OF THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA; CASE NO.
8-P-98; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has examined the application and staff
recommendation dated February 10, 1999; and
WHEREAS, the City Commission has determined that the application is in
compliance with all elements of the Comprehensive Plan for the development that is the
subject of the application; and
WHEREAS, at the time the plat was recorded, Broward County did not have the
benefit of a conceptual site plan for the property determination of entrance openings; and
WHEREAS, the property owner desires to move the access opening forty-six feet
(46') further to the south along NW 21 Avenue; move the eastern access opening along
Prospect Road forty-five feet (45) further east; and to increase the size from thirty feet (30)
to forty feet (40') to ensure compliance with the Site Plan (Case No. 27-SP-98) approved

by the City Commission on December 9, 1998; Resolution No. R-98-364; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve this
Delegation Request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the Delegation
Request to amend the location of openings in Non -Vehicular Limited Access Lines (NVAL)
on NW 21 Avenue and Prospect Road; specifically Lots 1 and 2 of the "Golfview Plaza"
Plat, according to the Plat thereof as recorded in Plat Book 121, Page 3 of the Public
Records of Broward County, Florida; Case NO. 8-P-98.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

This Resolution shall become effective immediately upon its
