CITY OF TAMARAC
RESOLUTION NO. R-99-�
A RESOLUTION FOR THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, TO
AUTHORIZE THE APPROPRIATE CITY
OFFICIALS TO PREPARE, SIGN, AND SUBMIT AN
APPLICATION TO THE COMMUNITY
DEVELOPMENT DIVISION OF BROWARD
COUNTY AS AN URBAN COUNTY RECIPIENT OF
FEDERAL GRANT PROGRAM FUNDS FOR
COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) FUNDS IN THE AMOUNT OF $300,000
FOR PARTIAL FUNDING OF A PROJECT TO
EXTEND WASTEWATER SERVICE TO A
PORTION OF TAMARAC LAKES SECTION 1;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, there is a residential section of approximately 75 homes in
the Tamarac Lakes section of the City of Tamarac that utilize individual septic
systems for the treatment and disposal of wastewater; and
WHEREAS, it has been shown that the use of a wastewater collection
system and a wastewater treatment facility provides more effective treatment and
disposal of wastewater and provides a much lower health risk than the use of
septic systems; and
WHEREAS, the City of Tamarac has planned a construction project to
extend wastewater collection lines to service the approximately 75 homes in the

Tamarac Lakes section of the City that currently use individual septic systems;
and
WHEREAS, the total cost of this planned construction project is
approximately $550,000; and
WHEREAS, Broward County, the Urban County Recipient of Federal
Grant Programs, is accepting applications for grant funding of eligible activities
through a competitive process; and
WHEREAS, federal regulations define this planned construction project as
eligible to receive grant funding through the Community Development Block
Grant (CDBG) program; and
WHEREAS, the
application for CDBG grant funding is required
to be
submitted to Broward
County Community Development Division on or
before
February 15, 1999; and
WHEREAS, the application to the Broward County Community
Development Division from the City of Tamarac requires the authorization of the
City Commission; and
WHEREAS, it is the recommendation of the Director of Utilities that the
City Commission authorize the appropriate city officials to prepare, sign and
submit an application to Broward County for CDBG grant funds in the amount of
$300,000 for a project to extend wastewater service to an area of Tamarac Lakes
that currently utilizes individual septic systems; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac that
they authorize the appropriate city officials to prepare, sign and submit an
application to Broward County funds for CDBG grant funds in the amount of
$300,000 for a project to extend wastewater service to an area of Tamarac Lakes
that currently utilizes individual septic systems.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific
part of this resolution.
SECTION 2: The appropriate city officials are authorized to
prepare, sign and submit an application to Broward County funds for CDBG grant
funds in the amount of $300,000 for a project to extend wastewater service to an
area of Tamarac Lakes that currently utilizes individual septic systems.
SECTION 3: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately
upon its passage and adoption.
