R-99-5� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE AWARD OF BID #99-05B FOR FIRE STATION NUMBER 78 RENOVATION TO ZURQUI CONSTRUCTION SERVICE, INC., AT A COST NOT TO EXCEED THREE HUNDRED SEVENTY THOUSAND EIGHT HUNDRED FIFTY FIVE DOLLARS ($370,855.00); APPROVING BUDGET TRANSFERS TOTALING THIRTY THOUSAND DOLLARS ($30,000); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac recognizes that Tamarac Fire Rescue requires additional space at Fire Station 78; and WHEREAS, Synalovski Gutierrez Architects, Inc. designed an addition and renovation of space at Fire Station Number 78; and WHEREAS, the City of Tamarac publicly advertised Bid #99-05B on January 17th and January 24th, 1999; and WHEREAS, eight bids were received and opened on February 17, 1999 and reviewed to determine cost and responsiveness to the City's specifications; and WHEREAS, Zurqui Construction Service, Inc. submitted the lowest responsive, responsible bid of $370,855.00 which included a Base Bid of $354,605.00; Alternate No. 1 — Lockers $8,300.00; Alternate No. 2 — Window Treatments $2,400.00; Alternate Temp. Reso #8536 Page 2 February 26,1999 No. 3 - Hose Storage Racks $3,800.00; Alternate No. 4 — Work Benches $1,750.00; as per the copy of the bid and tabulation attached hereto as "Exhibit A"; and WHEREAS, available funds exist in the Fire Rescue Fund budget for said purpose; and WHEREAS, it is the recommendation of the Fire Chief and Purchasing/ Contracts Manager that Bid #99-05B be awarded to Zurqui Construction Service, Inc. for a total not to exceed amount of Three Hundred Seventy Thousand Eight Hundred Fifty Five Dollars ($370,855.00); and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the award of Bid 99-05B for the construction of the addition and renovation of Fire Station 78 to Zurqui Construction Service, Inc. for a total not to exceed Three Hundred Seventy Thousand Eight Hundred Fifty Five Dollars ($370,855.00) and to transfer Thirty Thousand dollars ($30,000) from the contingency fund to the project. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The award of Bid #99-05B for the construction of the addition and renovation of Fire Station 78 to Zurqui Construction Service, Inc. for a total not to Temp. Reso #8536 Page 3 February 26,1999 exceed cost of Three Hundred Seventy Thousand Eight Hundred Fifty Five Dollars ($370,855.00) is HEREBY approved. Section 3: That the appropriate City officials are hereby authorized to accept and execute an Agreement with Zurqui Construction Service, Inc. for the construction of the addition and renovation of Fire Station 78 at as total cost not to exceed Three Hundred Seventy Thousand Eight Hundred Fifty Five Dollars ($370,855.00) as attached hereto as "Exhibit B". SECTION 4: That the City Manager or his designee be authorized to make changes, issue change orders not to exceed $10,000 per Section 6-156(b) of the City Code, and close the contract award including but not limited to making final payment and releasing bonds when the work has been successfully completed within the terms and conditions of the contract and within the contract price. SECTION 5: That Budget Transfers totaling Thirty Thousand dollars ($30,000.00) from Fire Rescue Fund account entitled "Contingency" to Fire Rescue Fund Account entitled "Station 78 Construction" is hereby approved to complete funding. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not effect the validity of the remaining portions or applications of this 1 [-I 1 Temp.
