RESOLUTION NO. R-99 -31
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO REFUND
TRAFFIC SIGNALIZATION IMPACT FEES PAID TO
THE CITY BY CARDINAL INDUSTRIES, INC. IN THE
TOTAL AMOUNT OF $12,884.00; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Resolution 83-230 adopted an agreement with Cardinal
Industries, Inc. accepting payment of traffic signalization fees in the amount of
$12,884.00; and
WHEREAS, based on Ordinance 98-6 and discussion at the City
Commission workshop of October 27, 1998, all developers are eligible for traffic
signalization fees refunds as long as they do not have an actual written
agreement to the contrary, including those without an agreement; and
WHEREAS, Cardinal Industries, Inc. has requested the refund of their
traffic signalization fees in the amount of $12,884.00, and there is no written
agreement to the contrary (See Attachment Exhibit 1); and
WHEREAS, the City Manager and Director of Finance recommend the
refund of the traffic signalization fees in the amount of $12,884.00; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
authorize the appropriate City officials to refund the traffic signalization fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and is hereby made a specific
part of this Resolution.
SECTION 2: The appropriate City Officials are hereby authorized
to refund traffic signalization impact fees paid to the City by Cardinal Industries,
Inc., in the total amount of $12,884.00.
SECTION 3: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

Tamarac, Florida, a public meeting has been advertised in accordance with applicable
law of the date, time and place of the meeting regarding the review of the applica-
ti.on•for a development order by the applicant for development approval; and
WHM AS, the City Council has examined and investigated the application,
staff and Planning Ccn dssion reoame_ndations, and the attached Development Review
Status Sheet dated 9/8 83 and
WHEREAS, the City Council reviewed the development order and acomgmnying
documents at a public meeting; and
WHEREAS, the City Council has determined that the application is in ca;r
plianee with all elements of its Comprehensive Plan, or will be in compliance prior
to the issuance of a Certificate of Occupancy for any limit on the development that
is the subject of the application.

SECTICN 1: That the develoMent described on the attached development review
status sheet dated 9 / 8 Z U 3is granted a development order to proceed subject to
the following conditions:
A. Construction is to be in cam. lete compliance with the plans and spec-
ifications mArdtted by the developer to the City of Tamarac as described in
Section II of the Development Review Status Sheet and approved engineering drawings,
B. Cam enoamnt of construction shall he no longer than one year from the
date of this approval. If the.development does not oamienee construction within
one year, this approval is null and void unless an extension has been granted in
accordance with applicable regulations.
C. The development order is assignable, but an assigratent does not
discharge any assignee tram strict compliance with the order unless the City Counci:
consents to modify any of the original regaurerents.

1. Approval is subject to submittal of a deed restriction
which will restrict this property to 62 units and not to
exceed one-story buildings;
2. The right-of-way will be sodded with Bahia grass.
SECTION 2: Should any section or provision of this development order be
declared by a court of ccmpetent jurisdiction to be invalid, the City Council shall
determine if the Other portions of the order remain valid or whether the approval
shall be null and void.

WHEFEAS, the City Council of the City of Tamarac, upon the

Code, the general description of the improvements to be constructed for the
area beginning at the Northwest corner of the lands owned by Southgate Gardens,
Inc., in an Easterly direction along Southgate Boulevard to the Southwest
corner of Northwest 71st Avenue are as follows:
An 8 inch ductile iron water line and
}fire hydrants fronting the above -described
property, including, but not limited to,
administrative and engineering design fees
and all other fees required by Code.

COMMENTS:
Following a public hearing on the subject rezoning petition, the City Council
accepted the affidavits of publication, posting and mailing. Council also
accepted on first reading, Temp. Ord. #1055 subject to the following conditions:
1. An 8" water line being installed which is needed from 71 Ave. to run to the end
of this property, which includes the existing Southgate Gardens.
2. A tri-party agreement is needed between the City, Cardinal Industries and Southgate
Gardens and Cardinal Industries has indicated that the City does not enter into the
cost of this line.
3. An agreement between the City and Gene Toll (Southgate Gardens) called Mission
Lakes at that time, stipulated that whoever builds on the other side of 71 Ave.,
which Mr. Toll constructed, would absorb half the cost of construction.
4. Approximately $7,042 would be assumed for this by Cardinal Industries. Until this
is resolved, the figure of $10,500 would be escrowed and the final figure between
Gene Toll and Cardinal Industries would be determined at which time overpaid monies
would be returned to Cardinal Industries.
5. Until such time, Cardinal Industries would be required to pay half of what is
presented to them.
6. Cardinal Industries has agreed to pay $2,000/unit for 10 additional units above
the number allocated to be earmarked for traffic control and street improvement
purposes.
7. Covenants limiting the number of units are needed and should be drawn up within
the next 2 weeks by a Letter of Agreement.
B. All agreements needed are to be presented to Council before the 7/27/83 meeting.
9. The number of units is to be no more than 62.
The second reading and public hearing of Temp. Ord. N1055 will be held at or after
2:00 p.m. on Wednesday, July 27, 1983.

Jon Henning read the Resolution by title and Mayor Falck opened and
closed the public hearing with no response. C/M Stelzer asked if there
were enough parking spaces in this location for a restaurant and the
City Planner said they will be recommending approving the revised
site plan which includes more parking required by the restaurant.
Jeffrey Gross, architect for the project and representative of Beverly
Hills'Cafe V, said the present owner of the shopping center is not the
original owner who built the shopping center. He said at the time the
center was built it was required that the Drainage Improvement Fee be
paid but it was never collected. Mr. Gross consulted with the owner
and said they are in agreement to pay that amount of $642.50.
V/M Massaro MOVED that Temp. Reso. 02773 be APPROVED authorizing the
special exception to permit the restaurant. SECONDED by C/M Stelzer.

is already platted. He said the City's Land Use Plan has shown this
parcel to permit between 10 and 15 dwelling units per acre. He said
the zoning is R3 and the applicant is requesting rezoning this property
to R4A to increase its density from 10 dwelling units per acre to 12

James Brady, representing Cardinal Industries, submitted a check to
the Assistant City Clerk for $100,872. V/M Massaro said the total
amount owed is $102,112.88, therefore, with the check that was submitted
there was a difference of $1,240. Mr. Brady said they have a reimburse-
ment under the escrow in connection with the payback of the road that
amounts to $2,006. therefore, deducting the $1,240 owed, there is a
balance of $766 to be reimbursed to Cardinal Industries.
h) Mr. Brady said Cardinal Industries has a certified copy of this and he
submitted it to Council.
g) V/M Massaro said additional conditions to site plan approval wouio be:
I. Authorization for the escrow agent to release funds effective with
the issuance of the first building permit in the following manner:
- the $30,500 which was paid to the City to be placed in escrow
account by agreement dated 8/l/83. The money, at the time of the
first building permit will be disbursed in the following manner:

a) Jon Henning read the Resolution by
title and Richard Rubin saiT-the applicant has received approval in
July, 1983 for rezoning to permit a total of 62 dwelling units on this
property. This is proposed as a rental project with an on -site manager
and staff recommends approval subject to the developer's agreement to
record a covenant restricting the density to 62 dwelling units in total
and one-story height. The size of the parcel is 5.2 acres, the Land
Use Plan permits up to 15 dwelling units per acre and this project
breaks down to 12 units per acre.
V/M Massaro MOVED APPROVAL of the Site Plan subject to a deed restric-
tion limiting this to 62 units and not to exceed one-story height,
APPROVING Temp. Reso. #2850, SECONDED by C/M Krantz. V/M Massaro
questioned Mr. Brady concerning the right-of-way being sodded with
bahia grass and he concurred that this would' be done.

b) Richard Rubin said the Beautification Committee has
reviewed this drawing and recommend approval. He said the developer
has included an areca palm hedge along the entire south property line
as requested by staff and this exceeds the minimum standards. V/M
Massaro said before the landscaping can be accomplished it will be
necessary to obtain a permit and the assessment for the inspection
fees is E3.225.63. She MOVED APPROVAL of the Landscape P1an,SECONDED

Through the passage of Resolution No. , and the city Commission of the city of
Tamarac authorized the refund of a performance bond(s), referred to as SOUTHGATE, paid by
Refundee on 03/30/1984 the amount of $12884.00.
Refundee shall indemnify and hold the City, its officers, employees and agents harmless and
defend the City, its officers, employees and agents from any and all claims, causes of action in
law or equity, damages, liability, and expenses, including attorneys fees, resulting from, arising
