RESOLUTION NO. R-98
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE PURCHASE OF
CLEARIGATE, A SOLE SOURCE HERBICIDE,
FROM FUTURE HORIZONS, INC., VARIOUS
REQUIRED CHEMICALS UTILIZING THE
SOUTH FLORIDA WATER MANAGEMENT
DISTRICT BID #98-004, VARIOUS REQUIRED
CHEMICALS UTILIZING THE BROWARD
COUNTY COOPERATIVE BID #B-98-09;
AUTHORIZING AN EXPENDITURE OF FUNDS
IN AN AMOUNT NOT TO EXCEED $51,040;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac, Public Works Department, requires
certain herbicides, algaecides and additives for waterways aquatic weed control
and rights -of -way plant control; and
WHEREAS, the City Code §6-151 allows the Purchasing/Contracts
Manager the authority to buy supplies from only one source, such as unique,
patented or franchised supplies; and
WHEREAS, the City Code §6-154 allows the Purchasing/Contracts
Manager the authority to join with other units of government in cooperative
purchasing when the best interest of the City would be served; and

WHEREAS, the City Code §6-155 allows the Purchasing/Contracts
Manager the authority to waive the purchasing procedures for all supplies, material
and equipment, which are the subject of contracts with other governmental
agencies; and
WHEREAS, the Public Works Department desires to purchase Clearigate,
an aquatic vegetation control agent, from the sole source State Municipal
distributor, Future Horizons, Inc. as stated hereto in attached Exhibit 1, in the
amount of $10,240; and
WHEREAS, the Public Works Department desires to purchase certain
required chemicals, in the amount of $6,500, utilizing the South Florida Water
Management District Bid, #98-004, effective through June 30, 1998, attached
hereto as Exhibit 2; and
WHEREAS, the Public Works Department desires to purchase certain
required chemicals, in the amount of $34,300, utilizing the Broward County
Cooperative Bid #B-98-09, effective through February 19, 1999, attached hereto
as Exhibit 3; and
WHEREAS, available funds exist in the operating supplies budget for said
purposes; and
WHEREAS, it is the recommendation of the Director of Public Works, City
Engineer, and Purchasing/Contracts Manager to purchase herbicides, algaecides
and additives utilizing all above mentioned sources; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interests of the residents of the City of Tamarac to purchase

herbicides, algaecides and additives to control nuisance aquatic weeds and rights -
of way plant control.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY
ratified and confirmed as being true and correct and is hereby made a specific part
of this Resolution upon adoption hereof.
SECTION 2: The purchase of Clearigate from Future Horizons, Inc.
utilizing the sole source State Municipal distributorship, in the amount of $10,240,
is HEREBY AUTHORIZED.
SECTION 3: The purchase of various aquatic chemicals, in the
amount of $6,500, utilizing the South Florida Water Management District Bid #98-
004, is HEREBY AUTHORIZED.
SECTION 4: The purchase of various chemicals, in the amount of
$34,300, utilizing the Broward County Cooperative Bid #13-98-09, is HEREBY
AUTHORIZED.
SECTION 5: All resolutions or parts of resolutions in conflict
herewith are HEREBY repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.

upon its passage and adoption.

Sealed bid envelopes should be marked with the bid name and number and boldly
marked "SEALED BID". All sealed bids should be delivered to the Purchasing
Division, 6591 Orange Drive, Davie, Florida 33314. Bids will be opened on or about
2:00 p.m., Tuesday, January 6, 1998, at the Davie Town Hall. This will be a public
bid opening.

Broward Co-operative Purchasing Group. The technical requirements of
this bid were reviewed by a committee of Parks and Recreation personnel
headed by Kathleen Connor, City of Fort Lauderdale. After reviewing the
