R-98- Id - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AUTHORIZING THE RISK MANAGER TO ADMINISTRATIVELY ADDRESS SETTLEMENT OFFERS REGARDING EMERGENCY TRANSPORT SERVICES PROVIDED BY THE FIRE RESCUE DEPARTMENT, WHEN THE SETTLEMENT IS IN THE BEST INTEREST OF THE CITY AND THE INITIAL BILL IS LESS THAN FIVE HUNDRED DOLLARS ($500.00); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Tamarac Fire Rescue Department provides emergency transport services; and WHEREAS, the City of Tamarac is asked to accept a reduced fee for services as part of a settlement between the patient and another party; and and WHEREAS, it may be in the best interest of the City to accept the settlement; WHEREAS, it is the recommendation of the Fire Chief that the Risk Manager be given the authority to handle these cases; and WHEREAS, the Risk Manager will review each case and accept or reject the settlement; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the City of Tamarac for the Risk Manager to accept settlement offers regarding emergency transport services when it is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE Temp. Reso. 8091 Page2 Revision #1: 01/06/98 CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The Risk Manager is authorized to administratively address settlement offers regarding emergency transport services provided by the Fire Rescue Department, when the settlement is in the best interest of the city and the initial bill is less than five hundred dollars ($500.00). SECTION 3: That all resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or Application, it shall not effect the validity of the remaining portions or applications of this Resolution.
