RESOLUTION NO. R-98- / 3
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AMENDING RESOLUTION R96-
212, AS AMENDED, TO INCREASE THE WATER
CONTRIBUTION CHARGE TO $1,400 PER ERC AND THE
WASTEWATER CONTRIBUTION CHARGE TO $1,800 PER
ERC; TO ESTABLISH AN INTEREST RATE FOR UNPAID
GUARANTEED REVENUE; PROVIDING FOR THE
COLLECTION OF CONTRIBUTION CHARGES IN THE AREA
FORMERLY KNOWN AS TAMARAC UTILITIES EAST (TUE);
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 22-189 of the Tamarac City Code requires that developers
contribute a portion of the cost of utility facilities as contribution charges; and
WHEREAS, the Tamarac City Commission is authorized to adopt the rates for these
contribution charges by resolution; and
WHEREAS, the Tamarac City Commission last authorized an increase in the
contribution charges in 1992 which established a water contribution charge of $1,205 per
equivalent residential connection (ERC) and a wastewater contribution charge of $1,550
per ERC; and
WHEREAS, a recent study of the contribution charges by a consultant to the City
has recommended a water contribution charge of $1,400 per ERC and a wastewater
contribution charge of $1,800 per ERC; and
WHEREAS, it is the recommendation of the Director of Utilities and the Director of

Finance that the City Commission adopt the contribution charges as recommended by the
consultant; and,
WHEREAS, it is the recommendation of the Director of Utilities and the Finance
Director that a new rate schedule be established by amending Resolution Number R96-
212, as amended by R97-202, and attached as Exhibit A, by modifying Part 5 of Section
F to reflect a water contribution charge of $1,400 per ERC and a wastewater contribution
of $1,800 per ERC; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to increase the water
contribution charge to $1,400 per ERC and a wastewater contribution charge to $1,800 per
ERC and modify the rate schedule to reflect these charges; and
WHEREAS, it is required under Section 22-190 (5) of the City Code that the City
Commission set by resolution a rate of interest equal to the maximum rate allowed by state
law for unpaid guaranteed revenue; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to set by resolution
an interest rate for unpaid guaranteed revenue and other unpaid charges; and
WHEREAS, the Tamarac Utilities East (TUE) historically did not collect contribution
charges from developers; and
WHEREAS, the issue of collection of contribution charges for new development

projects in the former TUE area was not discussed or resolved when the Tamarac Utilities
East (TUE) and the Tamarac Utilities West were merged in 1996; and
WHEREAS, it is desirable for the City Commission to clearly require the collection
of contribution charges on new development projects in the former TUE area; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to clearly require the
collection of contribution charges on new development projects in the former TUE area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: A current rate schedule is hereby created by amending Resolution
Number R96-212, as amended, to increase the water contribution charge to $1,400 per
ERC and the wastewater contribution charge to $1,800 per ERC.
SECTION 3: The City Commission authorizes an interest rate of ten percent (10%)
per annum (0.0275% per day) on all overdue guaranteed revenue and other overdue
charges, and that the new rate schedule (attached hereto as "Exhibit A") created by this
resolution contains a statement that sets forth this rate of interest.
SECTION 4: The rate schedule set forth as Exhibit A, Tamarac Utility Rate
Schedule for Water and Wastewater Services, shall be applicable to all customers of the

Water and Sewer Utility served by the City of Tamarac, including the areas formerly known
as Tamarac Utilities East (TUE) and Tamarac Utilities West (TUW).
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section other part or application of this resolution is held
by any Court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or application of this
Resolution.
SECTION 6: This Resolution shall become effective immediately upon its passage
and adoption.

TAMARAC UTILITY RATE SCHEDULE
FOR WATER AND WASTEWATER SERVICES
With respect to the application of rate and charges for water and wastewater services, the
following shall apply:
WASTEWATER is used interchangeably with the term "sewer" and in accordance with
terminology usage provided in Chapter 22, Utilities, of the City Code.
GENERAL SERVICE ACCOUNT means any entity that receives services but is not
classified as a single family dwelling, multiple family dwelling or commercial account.
COMMERCIAL ACCOUNT means any building or structure that is not used as a place
of residence.
DWELLING UNIT means a single unit providing complete, independent living facilities for
one (1) family, as defined in the land development code, including permanent provisions
for living, sleeping, eating, cooking and sanitation, but not including recreation vehicles,
tents, boats or tourist accommodations.
MULTIPLE -FAMILY DWELLING means any building designed for and containing: 1)
condominium units; and/or 2) apartment units.
SINGLE-FAMILY DWELLING means any building designed for and containing: 1) one
residential dwelling unit; 2) a group of residential dwelling units such as a duplex, triplex,
quadplex, etc.; and/or 3) a group of residential units such as townhouse or villa. A Single -
Family Dwelling would have individual utility services for electrical, plumbing and/or
mechanical system connections.

F. CONTRIBUTION (CIAC) CHARGES
1. In addition to the physical connection to and the installation of
a meter for the determination of consumption for both the water
and sewer system, the City shall charge a connection charge
which represents the capital facility cost of the water and sewer
system capacity utilized by the new connection.
2. The capital cost of the water and sewer capacity is calculated
on an Equivalent Residential Connection (ERC) basis, which
is defined as the maximum demand of three hundred fifty (350)
gallons per day (GPD) which equates to the demand for a
single-family dwelling unit. Meter size shall comply with the
requirements of the South Florida Building Code.

3. The ERC factors to be utilized for the determination of the
Connection Charges are based on user category and shall be as
follows:

Exception: If a general service connection serves living units such as
a hotel, motel, or time-share with efficiency units that include a kitchen
or kitchenette and/or laundry facilities, the connection charge shall be
the higher of the fee from the meter size schedule above or the
number of dwelling units based on the multiple -family ERC equivalent.
4. Future dumpster connections to sanitary sewer system shall pay CIAC
sewer charges based on each dumpster being one (1) ERC.

G. WATER RESTRICTION SURCHARGE ADJUSTMENT
In the event that the South Florida Water Management. District or other
authority having jurisdiction declares a water shortage requiring mandatory
curtailment to the extent of a 15 percent reduction in water usage, the
consumption charges listed above shall be increased 18 percent. In the
event that a reduction of water use in excess of 15 percent is required, the
City Commission may establish by resolution an appropriate surcharge
based upon a recommendation of the City Administration as to the revenue
required to comply with debt service covenants or to meet other
requirements of the water system.
H. MONTHLY MINIMUM CHARGE
No monthly bill, regardless of usage, shall be for less than the Service
Availability Charge based on the class of customer served and according
to the size of the meter through which service is furnished.
II. MONTHLY RATES AND CHARGES - WASTEWATER
A. SINGLE FAMILY RESIDENTIAL - WASTEWATER

DELI NQUENTIRETURN CHECK SERVICE CHARGES
When the City has service discontinued at the customer's premises for cause
or because of non-payment of amounts due, there shall be a service charge
of thirty dollars ($30.00) for the reestablishment of water service made during
normal working hours and a service charge of sixty dollars ($60.00) for the
reestablishment of service after normal working.
If the customer has not paid the current bill within 25 days of the date the bill

is rendered, the City will notify the customer of their delinquency and inform
them that if payment is not received and posted by a specific date and time
on or before 45 days from the original rendering date, service shall be
discontinued. A late payment charge of 10 percent of the bill will be applied
at 26 days and a delinquency charge as noted above will be applied at 45
days.
If a check is returned by the bank for insufficient funds, there will be a service
charge of $15.00 for each occurrence.
INTEREST
The City shall charge a rate of interest on all unpaid guaranteed revenue
charges, and the interest shall accrue from the due date of payment. The
rate of interest for these charges will be ten percent (10%) per annum
(0.0275 % per day).

E. TESTING OF WATER METERS
If a customer requests a water meter test and the meter is determined to be
accurate, the customer shall pay a fee according to the schedule below.
Should the test of the water meter prove the meter to be inaccurate, there
shall be no fee and the customers account will be adjusted.
The fees for testing of a water meter are as follows:

F. METER REREADS AND SPECIAL READINGS
Upon request of a customer, the City shall, without charge, re -read the
customer's meter to determine if the initial reading was accurate, provided
that a customer request for a meter re -read has not been made during the
preceding twelve (12) months. Should a customer request to have the meter
re -read more frequently than once every twelve (12) months, the customer
shall pay a charge of fifteen ($15) for each additional re -read. If the
customer requested re -read of the meter results in a correction, the meter re-
read charge shall be refunded and the customer's account will be adjusted.
Upon request of a customer to have a special meter reading performed
which is not a part of the month's reading during the normal billing cycle the
customer shall pay a charge of fifteen ($15.00) for the special reading.
G. DUAL CHECK VALVE RETROFIT INSTALLATION SINGLE FAMILY
RESIDENTIAL
Cost of dual check valve plus 15 percent for administrative cost.
H. UTILITIES' BACKFLOW DEVICE RECERTIFICATION FEE
For backflow devices requiring annual testing and recertification, the City's
annual fee for the recertification of such devices is twenty-five dollars
($25.00). This fee does not cover the cost of the inspection and testing of
the backflow devices by an independent certified backflow technician.

Costs for discretionary repairs to water and sewer lines on private property
by City utility or public works or for services for which no specific fee
applies shall be charged to consumer as follows:

Regular working hours for field personnel are defined as 7:30 a.m. to

IV. WATER AND SEWER USE CHARGE SYSTEM
In general, the Water and Sewer Use Charge system shall be operated such that
Utility rate charges at all times shall be sufficient to ensure that total annual
revenues will equal or exceed the sum of:
A. Annual Operations and Maintenance (O&M) of the Utilities System.
B. Annual funding for replacement of repair (R&R) of equipment, accessories,
or appurtenances necessary to maintain design capacity and performance
during the design life of all treatment works.
C. A prorata share of the general administrative expenses.
V. OTHER SPECIFICATIONS AND DEFINITIONS
A. Customers shall be billed by the City for services used on a monthly
basis.
B. Customers outside the corporate limits of the City receiving service
shall, in addition to the rates set, pay a surcharge of 25 percent on
water charges only.
C. Service availability charges shall be prorated for customers becoming
a part of or leaving the system during a billing cycle.
