R-98--/95 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACCEPTING A QUIT CLAIM DEED FROM BROWARD COUNTY, FLORIDA, OF COUNTY -OWNED PROPERTY, LOCATED IN TAMARAC, FLORIDA, ACQUIRED BY THE COUNTY BY VIRTUE OF THE PROPERTY BEING DELINQUENT AND VALOREM TAX PAYMENTS LANDS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the properties legally described as: 1. "FORT LAUDERDALE TRUCK FARM," 8-49-41, 4-31 D, Beg at NE cor of Lot 18, lying in "COLONY WEST ESTATES," PB 91-19B, NWLY 160, SWLY 75.59, SELY 144.41, NELY to POB. 2. The Village 80-19B, that part of the ingress -egress and utility easement lying between Parcels 1 &2. SUBJECT TO ALL EXISTING PUBLIC PURPOSE, UTILITY AND GOVERNMENT EASEMENTS AND RIGHTS OF WAY. located in the City of Tamarac, Florida have escheated to Broward County, Florida as a result of delinquent ad valorem tax payments; and WHEREAS, Fla. Stat. §197.592, requires land acquired by a county for delinquent ad valorem tax payments to be conveyed to the municipality in which it is located, free of any liens of record; and WHEREAS, Broward County, Florida has recorded a Quit Claim Deed for the transfer of the above -described property to the City of Tamarac, Florida, a copy of the recorded Quit Claim Deed is attached hereto as EXHIBIT 1; and Temp. Reso. # 8259 2 5/11 /98 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept the Quite Claim Deed from Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby accepts the Quit Claim Deed of the properties legally described as: 1. "FORT LAUDERDALE TRUCK FARM," 8-49-41, 4-31 D, Beg at NE car of Lot 18, lying in "COLONY WEST ESTATES," PB 91-19B, NWLY 160, SWLY 75.59, SELY 144.41, NELY to POB. 2. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of the Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 Cl Temp. The recitals set forth in the preamble to this Resolution are incorporated 1 by reference herein. I Section 2. The conveyance of these properties is hereby approved for no 2 consideration. 3 Section 3. Kraft, City Attorney RE: Broward County Quit Claim Deed - Temp Reso 8259 Our File: A95-129 MINOMMMMM Attached is correspondence from Gust Miller, Broward County Assistant Real Estate Officer, along with a copy of a recorded Deed and County Resolution No. 1998-162, conveying county - owned property to Tamarac. The property was acquired by virtue of being delinquent tax lands. In addition, I have attached a copy of proposed Tamarac Temp. Reso. 8259, accepting the Quit Claim Deed from Broward County. Fla. Stat. 197.592 requires lands acquired by a county for delinquent taxes, which land has not been previously sold or dedicated by the Board of County Commissioners, or conveyed to the fee simple title owner upon the owner making an application for its return, to be conveyed to the municipality, free of any liens of record. Broward County is authorized by the Florida Statutes to convey real estate owned by the county to municipalities of the State of Florida, at a private sale for such price, whether nominal or otherwise, as the Board may fix. The properties (noted in County Composite Exhibit A) have escheated to Broward County pursuant to Section 195.502(8), F.S., and in accordance with the statutes, Broward County has conveyed the properties to Tamarac.
