R-98- ,�200 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO CONVEY REAL PROPERTY TO JINDA LWIN AS CONSIDERATION FOR REAL PROPERTY RECEIVED FROM JINDA LWIN TO SECURE LAND FOR THE ULTIMATE CONSTRUCTION OF HIATUS ROAD; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida, wishes to construct Hiatus Road through Land Section Seven (7); and WHEREAS, one (1) of the primary parcels within the proposed road right-of-way was owned by Jinda Lwin; and WHEREAS, Jinda Lwin, conveyed real property and a public utility easement to the City of Tamarac to aid in the completion of Hiatus Road on July 9, 1997 (R-97-171); and WHEREAS, as consideration for Jinda Lwin's conveyance to the City of Tamarac, the City of Tamarac conveys real property, more particularly described in Exhibit "A" (attached hereto); and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to convey real property to Jinda Lwin as consideration for real I 1 1 June 24, 1998 - Temp. Reso. #8325 2 Revision No. 1 - July 1, 1998 property received from Jinda Lwin to secure land for the ultimate construction of Hiatus 01 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby approves the conveyance of real property as described in Exhibit "A" (attached hereto) to Jinda Lwin. SECTION 3: That the City Commission of the City of Tamarac, Florida, hereby authorizes the appropriate City Officials to grant such conveyance to Jinda Lwin and authorizes the appropriate City Officials to execute the Warranty Deed (attached hereto as Exhibit "B") and any other documents necessary to finalize the conveyance. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. DKC. 1 ,2000 CITY OF TAMARAC INTEROFFICE MEMORANDUM (98-06-039M) COMMUNITY DEVELOPMENT TO: City Manager DATE: July 8, 1998 FROM: Director of Community RE: Conveyance of Real Property to Development Jinda Lwin for Consideration of Real Property from Jinda Lwin for the Construction of Hiatus Road — Temp Reso #8325 Recommendation: The Director of Community Development recommends the City Manager review and approve the conveyance of real property to Jinda Lwin for consideration of real property from Jinda Lwin for the construction of Hiatus Road. Issue: In order for the City to develop the Hiatus Road corridor, it is required that certain property owners dedicate the necessary right-of-way for the section of roadway adjacent to their property according to the adopted right-of-way alignment (Exhibit 1"). Background: Hiatus Road is a regional north/south collector extending through Broward County. The Broward County Planning Council, recognizing the importance of Hiatus Road to the County's roadway network, approved a plan amendment which would preserve Hiatus Road throughout the County as a Trafficways Plan Corridor. Thus, in addition to providing access to several industrially zoned parcels within the Tamarac Commerce Park (Land Section 7), Hiatus Road will provide capacity relief to Nob Hill Road which parallels Hiatus Road to the east. In 1994, the City of Tamarac entered into an agreement with Carr Smith Associates to perform a planning study to extend Hiatus Road from Commercial Boulevard to McNab Road. Carr Smith Associates proposed three (3) different alignments, of which Alignment Option 1 (Exhibit "1 ") was recommended largely due to the property acquisition savings which would occur. The alignment provided a favorable and reasonably equitable solution for the dedications required from the property owners in order to construct Hiatus Road. Over the past year, there has been an increasing level of interest within the development community regarding imminent opportunities for the development of industrial/commercial property within Tamarac Commerce Park. Recognizing the importance of these economic development prospects to the success of the plan for the Park, the Commission employed Carr Smith Associates to proceed in expediting the efforts to acquire all of the right-of-way necessary for the construction of Hiatus Road. At the June 23, 1997 Workshop, Mr. Brian Mirson, President of Carr Smith Associates presented a status report to the City Commission regarding the dedication of land from the adjoining property owners. Mr. Mirson indicated that City staff, along with staff from Carr Smith City Manager Conveyance of Real Property for Hiatus Road Construction July 8, 1998 -- Page 2 Associates and Attorney Alan Ruf, have been working very closely over the past several months securing the additional lands required prior to construction of Hiatus Road.
