A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, VACATING
EASEMENTS AND RIGHTS -OF -WAY (R.O.W.)
WITHIN THE WOODMONT-BONAIRE
ENVIRONMENTALLY SENSITIVE LAND (ESL)
LOCATED AT NW 80 AVENUE, NORTH OF
MCNAB ROAD; SPECIFICALLY A PORTION OF
"WOODMONT 74 AND 75" ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT BOOK
108, PAGE 39 OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; CASE NO.4-P-
98; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the Rights -of -Way (R.O.W.) described in Exhibit "A" (attached hereto)
was dedicated to the public on September 10, 1980 (Resolution No. R-80-203) at the time
of the initial recordation of the Plat ; and
WHEREAS, the property owner, Broward County, has requested the Vacation of
Easements and Rights -of -Way (R.O.W.) within the Wood mont-Bonaire ESL located at NW
80 Avenue, north of McNab Road; specifically a Portion of "Woodmont 74 and 75",
according to the Plat thereof as recorded in Plat Book 108, Page 39 of the Public Records
of Broward County, Florida, in order to be consistent with the proposed revised site
development plan for the property; and
WHEREAS, the City Engineer and franchised Utility Companies have been

contacted and all have stated no objection to the Vacation of Easements and Rights -of -
Way (R.O.W.); and
WHEREAS, the Planning Commission recommended approval on July 1, 1998; and
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate the
Easements and Rights -of -Way (R.O.W.) within the Wood mont-Bonaire Environmentally
Sensitive Land (ESL) located at NW 80 Avenue, north of McNab Road; specifically A
Portion of °Woodmont 74 and 75", according to the Plat thereof as recorded in Plat Book
108, Page 39 of the Public Records of Broward County, Florida; Case No.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.

SECTION 2: That the Easements and dedicated Rights -of -Way (R.O.W.),
specifically a Portion of "Woodmont 74 and 75", according to the Plat thereof as recorded
in Plat Book 108, Page 39 of the Public Records of Broward County, Florida; Case No. 4-
P-98 (described in Exhibit "A"); IS HEREBY vacated.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

WHEREAS, pursuant to a notice of public hearing, duly and regularly advertised in
accordance with law, a public hearing was held in the Commission Meeting Room No. 422, Broward
County Governmental Center located at 115 South Andrews Avenue, Fort Lauderdale, Florida, on

right of County and the public to and in the public in r s r s m n hereafter described.
WHEREAS, after hearing all interested parties and determining that the proposed action
will not materially interfere with the County road system and will not affect the ownership of or
deprive any person convenient access to his/her premises, in accordance with the Florida Statutes (as
amended from time to time) it was determined that it would be to the best interest of all concerned
to renounce, disclaim, vacate and abandon any right to the County and the public to and in the

BE IT RESOLVED by the Board of County Commissioners of Broward County, Florida,

WHEREAS, pursuant to a notice of public hearing, duly and regularly advertised in
accordance with law, a public hearing was held in the Commission Meeting Room No, 422, Broward
County Governmental Center located at 115 South Andrews Avenue, Fort Lauderdale, Florida, on
Tuesday May 11, 1999 at ZLag P to consider the advisability of renouncing and disclaiming all

WHEREAS, after hearing all interested parties and determining that the proposed action
will not materially interfere with the County road system and will not affect the ownership of or
deprive any person convenient access to his/her premises, in accordance with the Florida Statutes (as
amended from time to time) it was determined that it would be to the best interest of all concerned
to renounce, disclaim, vacate and abandon any right to the County and the public to and in the
