CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-98- A0
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA AMENDING THE SALARY
FOR THE ASSISTANT CITY ATTORNEY PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on May 13, 1998, the City Commission approved a Resolution,
wherein the City authorized implementation of Performance -Based Pay System for
Executive, Managerial/Professional, and Administrative non -bargaining employees; and
WHEREAS, said Resolution provided that if a review of actual pay indicates the
employees' pay is not competitive with the local market, a market adjustment of up to
5% may be provided as determined by the City Manager after notification to the City
Commission to be effective January 1, 1998; and
WHEREAS, the City Attorney is the appropriate party to make determinations
regarding salary adjustments for the Assistant City Attorney; and
WHEREAS, the Assistant City Attorney's salary has been reviewed by the
Personnel Department and for it to be competitive with the market for Assistant City
Attorneys, it should be adjusted by 5% retroactive to January 1, 1998; and
WHEREAS, the Assistant City Attorney should be included as part of the City's
Performance -Based Pay System for Executive, Managerial/Professional and
Administrative non -bargaining employees; and

WHEREAS, the City Attorney recommends the City Commission's granting of a
one time 5% market adjustment and the inclusion of the Assistant City Attorney in the
performance based pay system for non -bargaining employees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS," clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution.
Section 2: The Salary for the Assistant City Attorney is adjusted by a one-time
market adjustment of 5%, effective January 1, 1998.
Section 3: The Assistant City Attorney will be included in the Performance -Based
Pay System, as implemented for other non -bargaining employees.
Section 4: All necessary budget transfers are hereby approved.
Section 5: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 6: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

Section 7: This Resolution shall become effective immediately upon adoption.
