R-98 Ab f0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH THE FEDERATION OF PUBLIC EMPLOYEES (FPE); AUTHORIZING BUDGETARY TRANSFERS OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 27, 1996, the City Commission approved the implementation of the City's Classification and Pay Plan, which included up-to- date descriptions and a pay plan in which compensation is based upon a specific ranking system; and WHEREAS, the City implemented a performance evaluation system to guide, direct, and provide feedback to employees effective October 1, 1997; and WHEREAS, during the strategic planning process in the spring on 1997, the City Commission identified improvements to the City's Management Practices and specifically improvements to the City's Compensation Plan as one of its priorities in order to assist the City to attract and retain a competent well - trained workforce to provide excellent services to the citizens of Tamarac; and WHEREAS, in May 1998 the City completed its analysis of the Bargaining Pay Plan; and Temp. Reso. #8329 June 30, 1998 WHEREAS, on May 13, 1998 the City Manager recommended and the City Commission approved a resolution authorizing the appropriate City officials to communicate with the Federation of Public Employees to request a limited purpose re -opener of the Contract between the City of Tamarac and the Federation of Public and Private Employees, Affiliated with District 1 — MEBA (AFL-CIO) in effect from October 1, 1996 through September 30, 1999 in accordance with article 32, Terms of Agreement, to discuss certain specific pay issues; and WHEREAS, the City of Tamarac created a negotiating team to negotiate changes to the current contract consisting of the Director of Personnel, the Director of Public Works, the Fiscal Services Manager, and a Personnel Analyst; and WHEREAS, the City of Tamarac and the Federation of Public Employees have collectively bargained in good faith and have reduced said bargaining to a Supplemental Agreement and it is anticipated that on July 7, 1998, the membership of the FPE will ratify the supplemental agreement; and WHEREAS, the salary cost of implementation for employees of record is approximately $31,000 for the balance of FY 98 with the funds available in the FY 98 Budget to fund these changes, at an annualized salary cost of approximately $123,000; and 6 1 Temp. Reso. #8329 June 30, 1998 WHEREAS, the City Manager and the City's negotiating team recommend approval of this amendment; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the agreement and provide for its proper execution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission approves the Supplemental Agreement, attached as "Attachment I", for employees of record effective on the date of approval by the City Commission and grants the City Manager authority to implements the changes to the pay. SECTION 3: The appropriate budgetary transfers of funds necessary for correct budgeting and accounting purposes related to implementation of the agreement is hereby approved. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 3 I 1 L Temp. Reso. #8329 June 30, 1998 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. ROBERTS 4 ATTACHMENT I r� u SUPPLEMENTAL AGREEMENT BETWEEN THE CITY OF TAMARAC AND THE FEDERATION OF PUBLIC EMPLOYEES A DIVISION OF THE NATIONAL FEDERATION OF PUBLIC AND PRIVATE EMPLOYEES AFFILIATED WITH DISTRICT 1 — MEBA (AFL-CIO) The City of Tamarac and the Federation of Public Employees, hereby amend the collective bargaining agreement entered into between the City of Tamarac and Federation of Public Employees on December 11, 1996, for the period from October 1, 1996 through September 30, 1999, as follows: Effective on the date of approval by the City Commission, eligible regular full-time and part-time employees of record whose pay falls below the midpoint of their pay range will receive a one-time hourly pay adjustment in accordance with the attached Exhibit A. This adjustment shall be a one-time adjustment and shall not establish a precedent or past practice nor shall it impose any future contractual obligation upon the City.
