RESOLUTION NO. R-98 -o?.Z.S
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE AWARD OF BID #98-25B
FOR THE PURCHASE OF AQUATIC,
ORNAMENTAL AND TURF HERBICIDES
FROM BOTH HELENA CHEMICAL
COMPANY AND TERRA INDUSTRIES;
AUTHORIZING AN EXPENDITURE OF
FUNDS IN AN AMOUNT NOT TO EXCEED
$135,600; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac, Public Works Department, requires
certain herbicides, algaecides and additives for waterways aquatic weed control
and rights -of -way plant control; and
WHEREAS, The City of Tamarac publicly advertised Bid #98-25B for the
purchase of aquatic, ornamental and turf herbicides in the Sun -Sentinel on May
315t and June 7t", 1998; and
WHEREAS, on July 8t", 1998, six (6) bids were opened and reviewed to
determine cost and responsiveness to the City's specifications; and
WHEREAS, Helena Chemical Company and Terra Industries submitted
the lowest responsive bid proposals. A copy of the Bid Tabulation being hereto
attached as Exhibit "A", and;

WHEREAS, sufficient funds are available from the Public Works,
Stormwater Division Operating funds; and,
WHEREAS, it is the recommendation of the Director of Public Works, and
the Purchasing/Contracts Manager that Bid #98-25B be awarded to the lowest
responsive and responsible bidders, Helena Chemical Company and Terra
Industries; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interests of the residents of the City of Tamarac to approve the
award of Bid #98-25B for the purchase of aquatic, ornamental and turf herbicides
to Helena Chemical Company and Terra Industries in an amount not to exceed
$135,600.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY
ratified and confirmed as being true and correct and are hereby made a specific
part of this Resolution upon adoption hereof.
SECTION 2: The award of Bid #98-25B to Helena Chemical
Company and Terra Industries in an amount not to exceed $135,600 is HEREBY
approved. A copy of the Bid Tabulation being hereto attached as Exhibit "A".
SECTION 3: There are sufficient funds available from the Public
Works, Stormwater Division Operating funds.

SECTION 4: All resolutions or parts of resolutions in conflict
herewith are HEREBY repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 6: This Resolution shall become effective immediately
upon its passage and adoption.
