L2-V A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO REFUND PERFORMANCE BONDS PAID TO THE CITY IN ACCORDANCE WITH VARIOUS PROJECTS ON JUNE 6, 1985 AND MARCH 28, 1986 BY BRUMA DEVELOPMENT IN THE TOTAL AMOUNT OF $4,370.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac requires the person, developer, owner, contractor or subcontractor who applies for a building permit to furnish to the city a good and sufficient bond; and WHEREAS, the contractor, subcontractor or other person having obtained a permit is responsible for the project until such work is accepted by the City through its designated agent, City Engineer or City Building Official; and WHEREAS, the City through its designated agent, City Engineer or City Building Official has determined the work of Bruma Development acceptable; and WHEREAS, Bruma Development has requested the refund of their performance bonds; and WHEREAS, the performance bonds are in the form of cash; and Temp Reso. #8300 June 8, 1998 Revision #1 June 16, 1998 WHEREAS, the City Manager and Assistant to City Manager recommend the refund of these performance bonds; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to refund the performance bond payments. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The appropriate City Officials are hereby authorized to refund the following performance bond payments paid to the City in accordance with various projects by the Bruma Development in the total amount of $4,370.00: A. File: Bruma, Project Number: 850606, Bond Date: June 6, 1985, Bond Amount: $2,000.00. B. File: Bruma, Project Number: 863003, Bond Date: March 28, 1986, Bond Amount: $1,185.00. C. File: Bruma, Project Number: 860329, Bond Date: March 28, 1986, Bond Amount: $1, 185.00. Section 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp Reso. #8300 June 8, 1998 Revision #1 June 16, 1998 Section 4: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 5: This Resolution shall become effective immediately upon its passage and adoption.
