A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO
PURCHASE LABORATORY TESTING SERVICES
UNTIL SEPTEMBER 30, 1999 UTILIZING THE
BROWARD COUNTY CO-OP BID NUMBER R-98-
217 AWARDED TO HARBOR BRANCH
ENVIRONMENTAL INSTITUTE, INC. FOR A
MAXIMUM TOTAL COST OF $19,000.00, WITH
FUNDING FROM THE APPROPRIATE UTILITIES
OPERATING ACCOUNT; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac is required by the Florida Administrative
Code 62-550 and the Broward County Department of Natural Resource
Protection to test the untreated well water and potable drinking water; and

WHEREAS, it is more cost effective for some testing to be performed by a
certified outside laboratory rather than the Water Treatment Plant Laboratory;
and
WHEREAS, the City Commission approved funding for laboratory testing
services in the FY99 budget under the appropriate Utilities Operational Account;
and

WHEREAS, the Broward County Governmental Purchasing Cooperative
Group awarded Bid R-98-217 (attached hereto as "Exhibit A") for the purchases
of laboratory testing services to Harbor Branch Environmental Institute, Inc.; and
WHEREAS, City Code Section 6-154 allows the Purchasing and Contracts
Manager the authority to join with other units of government in cooperative
purchasing when the best interest of the City would be served; and
WHEREAS, the Director of Utilities and the Purchasing and Contracts
Manager recommend the purchase of laboratory testing services from Harbor
Branch Environmental Institute, Inc.; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
approve the purchase of laboratory testing services from Harbor Branch
Environmental Institute, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:

SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific
part of the Resolution.
SECTION 2: That the purchase of laboratory testing services at a
maximum cost of $19,000.00 by the Purchasing/Contracts Manager as
authorized under Section 6-154 of the City of Tamarac Code from Harbor Branch
Environmental Institute, Inc. utilizing the Broward County Co-op Bid Number R-
98-217 until September 30, 1999, is hereby approved.
SECTION 3: The City Commission approves funding for laboratory
testing services in the FY99 budget.
SECTION 4: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

RESOLUTION NO. R--98-217
A RESOLUTION OF THE TOWN OF DAVIE, FLORIDA, EXTENDING THE BID FOR
LABORATORY TESTING OF DRINKING WATER AND WASTEWATER.
WHEREAS, the Town has previously awarded a bid for laboratory testing of drinking
water and wastewater by Resolution R-96-205; and
WHEREAS, the Town and the contractor wish to exercise the option to renew the bid
for an additional two year period; and
WHEREAS, after review, the Town Council wishes to extend the bid with Harbor
Branch Environmental Institute, Inc. through July 3, 2000.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF
DAVIE, FLORIDA:
SECTION 1; An extension through July 3, 2000 of the bid with Harbor Branch
Environmental Institute, Inc. for laboratory testing of water and wastewater, is hereby
accepted by the Town Council.
SECTION 2. The Town Council authorizes this expenditure from the Utilities
Department -Compliance Testing and Water Chemicals Account.

Subject: Laboratory Testing of Drinking Water and Wastewater
The attached resolution is to provide laboratory testing services for drinking water and wastewater
samples on an as needed basis. The Town acted as lead agency for the Broward Co-operative
Purchasing Group in bidding these services.
The original contract was for a two year period with an option to extend for two additional two
year terms by mutual consent of the parties. This resolution concerns the first two year extension
as the Town, other participating co-op members and the vendor wish to exercise the contractual
option.
The vendor did request some price relief to cover costs on certain chemicals whose cost
skyrocketed over the past year and also to cover additional costs incurred due to revised testing
procedures mandated by the State of Florida. After reviewing the requested price relief in
comparison to the original bid (done 2 years ago), we find that Harbor Branch is still the low
bidder. In addition, the revised pricing would be in place an additional two years.

SUBJECT: Harbor Branch Contract Extension
have reviewed the proposed price increase requested by Harbor Branch for certain parameter
testing. I feel that their request is justified due to the cost of raw material they need to perform tests
and the additional testing required by the State of Florida on Chapter 62-550. 1 have reviewed the
original bid and even after the increase, Harbor Branch is still the lowest bidder.
Over the past two years, the Town has had a very good working relationship with Harbor Branch.
Therefore, it is my recommendation to extend this contract for two additional years.
