R-98- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA DESIGNATING FIRST UNION NATIONAL BANK OF FLORIDA AS THE CITY'S DEPOSITORY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac on April 26, 1995 approved Resolution Number R-95-88, selecting First Union National Bank of Florida to serve as the City's depository and entered into a five (5) year agreement with said depository; and WHEREAS, the City Charter Section 7.08(a) stipulates that the City Commission of the City of Tamarac shall designate annually the City's depository; and WHEREAS, First Union National Bank of Florida has sufficiently adhered to the terms of the agreement; and WHEREAS, the City Manager and Interim Director of Finance recommend designating First Union National Bank of Florida as the City's Depository; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to designate First Union National Bank of Florida as the City's depository. Temp. Reso. #8363 September 9, 1998 Page 2 Revised 8/26/98 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing `WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The City Commission of the City of Tamarac hereby designates First Union National Bank of Florida to serve as the City Depository through April 1999. Section 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution.
