R-98,d �7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE AMENDMENT TO CURRENT CLASSIFICATION AND PAY PLAN; APPROVING IMPLEMENTATION OF NEW PAY STRUCTURE FOR THE CODE ENFORCEMENT OFFICER I AND CODE ENFORCEMENT OFFICER II; AUTHORIZING THE APPROPRIATE BUDGETARY TRANSFER OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Code Enforcement Officer is responsible to uphold the municipal code of ordinances, and applicable State and Federal Laws; and WHEREAS, such laws relate to the City's community standards, which provide for a clean, safe, well maintained, and desirable community; and WHEREAS, the City of Tamarac recognizes the need to attract qualified candidates and to retain the certified Code Enforcement Officers currently working for the City; and WHEREAS, the City of Tamarac has been unsuccessful in its latest two attempts to attract acceptable quality candidates for the existing Code Enforcement Officer vacancies; and WHEREAS, similar experience by neighboring Cities confirm that certified Code Enforcement Officers have become a scarce commodity in our area; and 1 Temp. Reso. # 8378 Rev. # 1 - 9/1 /98 WHEREAS, Cities within the Broward County area have aggressively y modified their pay plans to attract the limited number of existing certified Code Enforcement Officers; and WHEREAS, the City of Tamarac wishes to implement pay plan changes encompassing the consolidation of the existing Code Enforcement Officer I and Code Enforcement Officer II pay grades 12 and 14 into one Broadband, with established milestones corresponding to a skill based progression plan; and WHEREAS, the City of Tamarac will be able to hire a non -certified but otherwise qualified individual, and said individual will be able to progress through the range as they achieve the established milestones; and WHEREAS, the City of Tamarac will be able to competitively hire a certified Code Enforcement Officer, by offering a starting salary commensurable with the milestones the individual has already accomplished; and WHEREAS, individuals will be allowed to progress through the range as they achieve established milestones; and WHEREAS, current employees of the Code Enforcement Division of the Community Development Department, in the classifications affected by mentioned plan changes, will be adjusted in grade and pay according to the milestones achieved, and thereafter will be allowed to progress through the range as they achieve established milestones following the same rules as established by the amendment; and WHEREAS, the Federation of Public Employees supports this amendment and its implementation; and 0 Temp. Reso. # 8378 Rev. # 1 - 9/1 /98 WHEREAS, the total cost of implementation for current employees is approximately $317.00 for the balance of FY 98 with the funds available in the FY 98 Budget to fund these changes, at an annualized cost (based on filling the 2 current vacancies at highest milestone level - $30,580) of approximately $17,740, and WHEREAS, the Director of Personnel and the Community Development Director recommend approval; and WHEREAS, the City Commission of the City of Tamarac, Florida finds it to be in the best interest of the citizens and residents of the City of Tamarac to amend the current classification and pay plan to implement a new pay structure for Code Enforcement Officers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission approves the amendment to the City's current Bargaining Unit Pay Plan attached as "Exhibit A", and grants the City Manager authority to make such changes to the pay plan, as necessary. SECTION 3: That the City Commission approves application of the Pay Plan Amendment to current employees of the Community Development Department, effective September 9, 1998. Temp. Reso. # 8378 Rev. # 1 - 9/1 /98 SECTION 4: The appropriate budgetary transfers of funds necessary for correct budgeting and accounting purposes related to implementation of the agreement is hereby approved. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: This Resolution shall become effective immediately upon its passage and adoption.
