CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-98- 13
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, APPROVING THE
PURCHASE OF AN AS/400 OPERATING SYSTEM
SOFTWARE UPGRADE FROM IBM CORPORATION
AT A COST OF $22,806.90; APPROVING BUDGET
TRANSFERS IN THE AMOUNT OF $22,806.90;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission approved the acquisition of a new Municipal
Information System from HTE, Inc. on April 9, 1997; and
and
WHEREAS, the City's AS/400 operating system software is Version 3 Release 7;
WHEREAS, the version and release currently available for the IBM AS/400 is
Version 4 Release 3; and
WHEREAS, the proposed operating system software upgrade would eliminate the
need for MIS staff to perform certain interface functions that could be performed by users
from within their systems; and
WHEREAS, the proposed operating system software upgrade would enable the
users to transfer files between AS/400 and their PC's on their own; and
WHEREAS, the proposed operating system software upgrade would enable the City
to take advantage of the latest technology available including Internet capabilities; and
WHEREAS, the City solicited bids from fifteen (15) potential bidders; and
WHEREAS, the City received two (2) written "no bids", one (1) verbal no bid; and

WHEREAS, the City of Tamarac Code Section 6-149(b)(9) provides for the
purchasing of this item with the approval of the City Commission without any further
bidding requirements when no bids are received; and
WHEREAS, it is the recommendation of the Director of Management Information
Services and the Purchasing and Contracts Manager to purchase the AS/400 operating
system software upgrade from IBM Corporation at a cost of $22,806.90; and
WHEREAS, the AS/400 operating system software upgrade is an IBM product and
is directly available from IBM Corporation, and
WHEREAS, the funding for the AS/400 upgrade is available in the MIS budget; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to purchase the
AS/400 upgrade operating system software from IBM Corporation at a cost of $22,806.90.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and is hereby made a specific part of this Resolution.
SECTION 2: The appropriate City Officials ARE HEREBY AUTHORIZED to
purchase the AS/400 upgrade operating system software from IBM Corporation at a cost
of $22,806.90.
SECTION 3: Budget transfer in the amount of $22,806.90 from the MIS
Computer Hardware account to the MIS Operating Supplies - Software account is hereby
approved for correct accounting purposes.

SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.
