R-98 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS TO REFUND A PERFORMANCE BOND PAID TO THE CITY BY CHEVRON COMPANIES IN THE AMOUNT OF $20,866.25; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac requires the person, developer, owner, contractor or subcontractor who applies for a building permit to furnish to the City a good and sufficient bond; and WHEREAS, the contractor, subcontractor or other person having obtained a permit is responsible for the project until the project is complete and the work is approved by the City through its designated agent, City Engineer and City Building Official; and WHEREAS, Chevron Companies was the developer of a project located at the corner of Pine Island Road and Commercial Boulevard which required a performance bond for utilities, side walks, paving and drainage improvements; and WHEREAS, Chevron Companies have completed this project and the City through its designated agent, City Engineer and City Building Official have no record of outstanding issues for this project which would prohibit the release of said performance bond; and Temp. Reso. #8384 September 4,1998 Page 2 Revision #1 10/07/98 WHEREAS, Chevron Companies has requested the refund of their performance band; and WHEREAS, the performance bond is in the form of cash; and WHEREAS, the City Manager and Interim Director of Finance recommend the refund of this performance bond; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to refund the performance bond payment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: The appropriate City officials are hereby authorized to refund the following performance bond payment paid to the City by Chevron Companies in the amount of $20,866.25, after the City of Tamarac receives the signed and notarized Indemnification, Hold Harmless and Release Form for the project listed below. A. File: Chevron, Project Number: 901904, Bond Date: September 5, 1991, Bond Amount: $20,866.25 SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Reso. #8384 September 4,1998 Page 3 Revision #1 10/07/98 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
