Reso. #8398, September 18, 1998 1 Revision 1, October 5, 1998 CITY OF TAMARAC, FLORIDA RESOLUTION # R-98­3 // A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE A ONE- YEAR EXTENSION OF BID NO. 97-21 B ENTITLED "REMOVAL AND DISPOSAL OF LIME SLUDGE" ISSUED TO L.B. TRUCKING AND CONSTRUCTION INC., FOR AN AMOUNT NOT TO EXCEED $49,530.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, lime sludge is a by-product of the Water Treatment process and must be removed and disposed of from the Water Treatment Plant site; and WHEREAS, the City of Tamarac awarded Bid Number 97-21 B to L.B. Trucking and Construction, Inc., to remove and dispose of lime sludge for a one-year period expiring on September 30, 1998; and WHEREAS, the original bid provides a renewal term for two (2) additional one- year extension periods at a cost not to exceed $49,530.00. This is the first year of the extension period; and WHEREAS, available funds exist in the Utilities Operational Fund budget for said purpose; and Temp. Reso. #8398, September 18, 1998 2 Revision 1, October 5, 1998 WHEREAS, L.B. Trucking and Construction, Inc. has agreed to a one-year extension for removal and disposal of lime sludge at a cost of $49,530.00 set forth in the original bid proposal, which is a 0% increase; and WHEREAS, it is the recommendation of the Director of Utilities and the Purchasing and Contracts Manager that the bid be extended for one year to L.B. Trucking and Construction, Inc.; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to extend for one year, Bid Number 97-21 B entitled "Removal and Disposal of Lime Sludge" to L.B. Trucking and Construction, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Resolution. SECTION 2: That the appropriate City Officials are hereby authorized to extend Bid Number 97-21 B for the removal and disposal of lime sludge for a one-year period expiring on September 30, 1999, to L.B. Trucking and Construction, Inc., in an amount not to exceed $49,530.00, Temp. Reso. #8398, September 18, 1998 Revision 1, October 5, 1998 SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this 3 Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
