R-98- 3 3 C/ A RESOLUTION OF THE CITY COMMISSION TO AUTHORIZE THE APPROPRIATE CITY OFFICIALS TO ACCEPT AND APPROVE A PROPOSAL FROM GOVERNMENT SERVICES GROUP, INC. ("GSG") TO DEVELOP A UTILITIES SYSTEM IMPROVEMENTS ASSESSMENT PROGRAM FOR THE NORTHERN HALF OF LAND SECTION 7 IN THE AMOUNT OF $27,600; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is currently constructing water and sewer system improvements as part of the Hiatus Road Project in the northern half of Land Section 7; and WHEREAS, the City is utilizing allocated Utilities Construction In Aid of Construction (CIAO) funds for the construction of the utilities system improvements; and WHEREAS, the utilities system improvements will facilitate the development of the properties within the northern half of Land Section 7 and directly benefit the owners and developers of those properties; and WHEREAS, the costs of such utility improvements are generally the responsibility of the owners or developers of the property impacted by the improvements; and WHEREAS, the establishment of a special assessment on the properties in the northern half of Land Section 7 would provide a mechanism by which the City could recoup the costs of the utility system improvements; and Temp. Reso. #8415, October 22, 1998 2 WHEREAS, it is the recommendation of the Director of Utilities that the proposal from Government Services Group, Inc. ("GSG"), to the City of Tamarac, to develop a Utilities System Improvements Assessment Program for the northern half of Land Section 7 in the amount of $27,600 be accepted and approved; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it in the best interest of the citizens and residents of the City of Tamarac to accept and approve a proposal from Government Services Group, Inc. ("GSG"), to the City of Tamarac, to develop a Utilities System Improvements Assessment Program for the northern half of Land Section 7 in the amount of $27,600. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That the appropriate City Officials are hereby authorized to accept and approve a proposal from Government Services Group, Inc. (°GSG'), to the City of Tamarac, to develop a Utilities System Improvements Assessment Program for the northern half of Land Section 7 in the amount of $27,600. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, Temp. Reso. #8415, October 22, 1998 3 in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Evaluate proposed project(s); determine and obtain the necessary data. Evaluate the proposed capital projects and with the assistance of the City Utility Director and his department determine and obtain the data and information necessary to develop an assessment methodology approach. Such data may include the GIS database, tax roll information, other non -ad valorem tax based revenue information for the properties in the area and land -use data. Task 2. Locate the proposed projects and determine the benefited properties. Using a GIS database, determine the preliminary location of the proposed projects to serve as basis for identifying geographic areas benefited by the projects. Task 3. Develop a preliminary assessment methodology. Using the data and criteria established by City staff and officials, NG&N and GSG will develop a preliminary assessment methodology based on the proposed projects, their location and properties benefited by the projects. This methodology may require the development of capacity figures for each potential parcel. If detailed data is not available, NG&N and GSG will use current land -use information. Task 4. GIS boundary description of the benefit areas. NG&N and GSG will develop a GIS-based boundary description of the benefit areas. Task 5. Create a preliminary database. Using the boundary descriptions and the most current ad valorem tax roll, create an preliminary database. Augment the database with other pertinent data determined to support the apportionment methodology. Task 6. Determine the assessment revenue requirements. Review the funding requirements of the proposed projects, including debt service requirements. Based on these funding requirements, determine the total assessment revenue requirements for the proposed projects including program implementation costs and annual costs. Task 7. Apply apportionment methodology to preliminary database. Apply the preliminary apportionment methodology to the preliminary database to test the data validity and sufficiency. Modify the database and/or revise the apportionment methodology as necessary. A-1 Task 8. Calculate a proforma schedule of rates. Calculate a proforma schedule of rates based on the apportionment methodology and revenue requirements for the assessment program. Provide alternative revenue scenarios if required. Task 9. Prepare and present an assessment report. Prepare and present an assessment report which identifies the proposed projects, describes the benefit areas, provides a description of the apportionment methodology including all underlying assumptions, assessment rate calculations, legal sufficiency review, and an implementation schedule in conformance with the Uniform Method of collection. Task 10. Draft home rule capital assessment ordinance. NG&N and GSG will provide the City with the flexibility to impose and collect these capital assessments using the tax bill or traditional collection methods. Task 11. Draft initial assessment resolution. Draft the initial assessment resolution to conform to the capital assessment ordinance to implement the City's policy decision of proposed methodology. Task 12. Prepare final assessment resolution. Prepare the final assessment resolution that conforms to the capital assessment • ordinance to impose capital assessments and adopt final assessment rates. Task 13. Prepare final assessment roll. GSG will prepare the final assessment roll that will implement the assessment program and will interface with the Broward County Department of Revenue Collection. Task 14. Advise and assist with implementation requirements. Advise and assist with the legal requirements for adoption of the final rates and certification of the assessment roll in accordance with the Uniform Method including: a) the development of the first class notice and its distribution, b) publication of the public hearing, c) development of a public information sheet, d) attendance at the public hearing, and e) the certification of the assessment roll to the Broward County Department of Revenue Collection. Task 15. Develop a plan to provide ongoing annual maintenance of the assessment program. Provide the City with a plan for ongoing assessment administration services to maintain the assessment program and database foundations, including electronic capability to access the annual assessment roll, annual updates of the databases (e.g., update assessment roll to reflect updates to ad valorem tax roll), assistance in monitoring the apportionment methodology and annual implementation services to ensure adherence to statutory timeframes. If requested, the plan will outline the process for the City to maintain the assessment database. OVA L-] • • Fees and Costs For services provided by NG&N and GSG, the lump sum professional services fee for the proposed scope of services will be $27,6000, Lump sum professional fees will be due and payable pursuant to the schedule attached as Appendix C under a percent - complete basis. The lump sum fee assumes attendance at the public hearing to adopt final assessment rates. Compensation for additional meetings shall be on an hourly basis at the at the hourly rates of $175 per hour for Firm Principals and $125 per hour for Project Manager plus additional actual costs incurred. The statement detailing the fees and costs for such additional services shall be billed monthly for the time and costs incurred the previous month. Special Note: The lump sum fee does not include the costs of producing and mailing the statutorily required first class notices for Fiscal Year 1999-2000, which will depend on the number of assessable parcels of property within the City. Mailing and production costs for both programs average approximately $.75 per parcel, with 50% of that amount due and payable at the time of the adoption of the initial assessment resolution, with the remainder being due upon issuance of the notices. ("GSG", Special Assessmen A Resolution of the City Commission to authorize the appropriate City Officials to accept and approve a proposal from Government Services Group, Inc. ("GSG'), to develop a Utilities System Improvements Assessment Program for the northern half of Land Section 7 in the amount of $27,600. Issue: To accept and approve a proposal from Government Services Group, Inc. ("GSG"), to develop a Utilities System Improvements Assessment Program. • Background: The City is currently constructing water and sewer system improvements as part of the Hiatus Road Project, in the northern half of Land Section 7.
