RESOLUTION NO. R-98-�_
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA APPROVING THE PURCHASE OF
TIRES FROM WALEEN TIRE COMPANY, UTILIZING STATE
OF FLORIDA CONTRACT #863-000-95-1 FOR A TOTAL NOT
TO EXCEED $30,000.00 ANNUALLY, APPROVING FUNDING
FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, The State of Florida awarded Contract #863-000-95-1 to Waleen Tire
Company, an authorized Goodyear Tire Center on March 15, 1995 and has renewed this
contract annually with a current expiration date of March 14, 1999; and
WHEREAS, City Code §6-155 allows the waiver of purchasing procedures for all
supplies, materials and equipment which are the subject of contracts with the State of
Florida; and
WHEREAS, it is the recommendation of the Director of Public Works, the Fire
Chief and the Purchasing/Contracts Manager that the purchase of tires be awarded to
Waleen Tire Company for an amount not to exceed $30,000 annually for a period to
coincide with the State of Florida Contract #863-000-95-1 and to allow for future
renewals of this contract assuming all terms and conditions of this contract remain
equal; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to purchase tires from
Waleen Tire Company; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing 'WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution upon
adoption hereof.
SECTION 2: The appropriate City Officials are hereby authorized to purchase tires
from Waleen Tire Company for a period to coincide with the State of Florida Contract #863-
000-95-1, attached hereto as Exhibit A, and to allow for future renewals of this contract
assuming all terms and conditions of this contract remain equal.
SECTION 3: Funding is available for the purchase of tires from the appropriate
account at a total cost not to exceed $30,000 annually.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 6: This Resolution shall become effective immediately upon its passage
and adoption.
