RESOLUTION NO. R-98- -.3J5_D
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXTEND AND EXECUTE AN AGREEMENT
BETWEEN THE CITY OF TAMARAC AND HOMESTEAD VILLAGE,
INC.; FOR THE RENTAL OF A ROOM PROVIDING QUARTERS
FOR TAMARAC FIRE RESCUE PERSONNEL FROM JANUARY 1,
1999 THROUGH DECEMBER 31, 1999; RE-ESTABLISHING A
WEEKLY RATE OF $252.00; PROVIDING FOR MONTHLY
PAYMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac provides Fire and Emergency Medical Services to the
community; and
WHEREAS, the City maintains a Fire Rescue Engine and a medical transport ambulance
at Fire Station 78 located at 4801 West Commercial Boulevard; and
WHEREAS, the City has increased the staff assigned to Fire Station 78 to meet the needs
of the community; and
WHEREAS, Fire Station 78 was built in 1980 and was not designed to house the current
number of assigned staff; and
WHEREAS, the City Commission has recognized the need to improve the facilities at Fire
Station 78; and
WHEREAS, the City has authorized building an addition to Fire Station 78; and

WHEREAS, the City Commission recognizes the immediate need to provide temporary
facilities for the staff at Fire Station 78; and
WHEREAS, Homestead Village, Inc. has been providing the facilities needed by the
City at a rate of $289.00 per week to be paid monthly; and
WHEREAS, Resolution No. R-98-72, which approved the initial Agreement between the City
of Tamarac and Homestead Village, Inc. was approved on March 11, 1998 and expires on
December 31, 1998; and
WHEREAS, funding has been approved by the City Commission and is available; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the City of Tamarac to temporarily locate a medical transport unit and assigned
staff at Homestead Village.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: The appropriate City officials are hereby authorized to extend and execute
the Room Rental Agreement between the City of Tamarac, Florida, and Homestead Village, Inc.
for the rental of a room at a cost of $252.00 per week for the period of January 1, 1999 through
December 31, 1999. (A copy of the Agreement is attached as Exhibit "A".)
SECTION 3: That all resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not effect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its passage
and adoption.

ROOM RENTAL AGREEMENT

THIS AGREEMENT made this ' day of December, 1998, by and
between the CITY OF TAMARAC (hereinafter called City), a municipal corporation
with primary offices located at 7525 N.W. 88"' Avenue, Tamarac, Florida 33321 and
HOMESTEAD VILLAGE, INC., (hereinafter called Owner), a Georgia corporation
with primary offices located at 2100 Riveredge Parkway, 9'h Floor, Atlanta, Georgia
30328.
WITNESSETH:
The City and the Owner in consideration of the mutual covenants hereinafter set
forth, agree as follows:
1. The City shall rent one (1) room located at Homestead Village, 3873 West
Commercial Blvd., Tamarac, FL 33309 from Owner beginning on
• January 1, 1999 and ending at check-out time on December 31, 1999.

2. The room shall contain three (3) single beds and all normal amenities
usually extended to persons lodging in similar rooms at Homestead
Village.
3. The room rental shall be $252.00 per week. This rate shall remain fixed
and unchanged for the term of this agreement unless Owner offers a lower
rate. The Owner shall not charge and the City shall not pay any taxes of
any kind for the room rental.
4. Owner shall invoice the City monthly for the room rental. The City shall
remit payment to Owner within thirty (30) days of receipt of invoice.

IN WITNESS WHEREOF, the parties have made and executed this Agreement
on the respective dates under each signature. City of Tamarac, through its Mayor, and
Homestead Village, signing by and through its Operations Manager, duly authorized to
execute the same.
