Reso #8494 1 Revision # 1 -- December 21, 1998 CITY OF TAMARAC, FLORIDA RESOLUTION NO R-98-A 77 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR SCHOOL CROSSING GUARD SERVICES WITHIN THE CITY OF TAMARAC; PROVIDING FOR CONFLICTS; PROVIDING FOR SERVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac promotes the safety and well being of children walking and bicycling to school; and WHEREAS, Alpha Temporary Services, Inc. has provided the School Crossing Guard Services for the City of Tamarac in compliance of their contract which was extended for one (1) year by adoption of Resolution R-98-169, effective October 1, 1997; and WHEREAS, Alpha Temporary Services, Inc., has defaulted in its contract by its written notification to the City of Tamarac, dated December 15, 1998, that it will no longer be providing school crossing guard services as of December 31, 1998; and WHEREAS, the City needs to secure school crossing guard services, as soon as possible, to commence on January 4, 1999; and WHEREAS, the City does not have a contract to be approved by the City Commission prior to January 4, 1999; and 1 December 18, 1998 - Temp. Reso #8494 2 Revision # 1 - December 21, 1998 WHEREAS, the City commission finds that an emergency exists because a school crossing guard contract does not exist after December 31, 1998; and WHEREAS, the City Commission can authorize the City Manager to negotiate and execute a contract with a replacement independent contractor and realize continuous school crossing guard services for the City of Tamarac until September 30, 1999; and WHEREAS, the City will prepare a Competitive Bid for School Crossing Guard Services for future services through competitive bidding; and WHERAS, the City will retain the thirty (30) day termination clause in its agreement for failure to perform the agreed terms and conditions; and WHEREAS, it is the recommendation of the Director of Community Development that the City Manager be authorized to negotiate and execute the School Crossing Guard Contract; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to provide for a timely execution of a contract for School Crossing Guard Services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Reso #8494 3 Revision # 1 -- December 21, 1998 SECTION 2: That the City Manager is hereby authorized to negotiate and execute a contract for school crossing guard services with an independent contractor to begin immediately upon execution and which will expire on September 30, 1999. SECTION 3: All resolutions or parts of resolution in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 L] 1 December 18, 1998 - Temp.
