RESOLUTION NO. R-98 -5-3
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO 1) APPROVE AN
ASSIGNMENT OF THE WATER AND SEWER
DEVELOPER'S AGREEMENT WITH LENNAR HOMES, INC.,
FOR THE KINGS POINT COMMERCIAL PLAZA PROJECT
TO LEISURE COLONY MANAGEMENT CORPORATION, 2)
APPROVE AN ACCEPTANCE AND ACKNOWLEDGMENT OF
AGREEMENT AND CONSENT TO ASSIGNMENT
EXECUTED BY LEISURE COLONY MANAGEMENT
CORPORATION, AND 3) APPROVE AND EXECUTE AN
ACKNOWLEDGMENT OF AGREEMENT AND CONSENT TO
ASSIGNMENT BETWEEN LENNAR HOMES, INC., AND
LEISURE COLONY MANAGEMENT CORPORATION FOR
THE KINGS POINT COMMERCIAL PLAZA PROJECT
LOCATED ON THE SOUTHEAST CORNER OF NOB HILL
ROAD AND NW 77T" STREET; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Lennar Homes, Inc., executed a Water and Sewer Developer's
Agreement with the City of Tamarac on June 12, 1996; and
WHEREAS, Lennar Homes, Inc., developer of the Kings Point Commercial Plaza
Project located on the southeast corner of Nob Hill Road and NW 771h Street (attached
hereto in map form as "Exhibit 1") transferred ownership to Leisure Colony Management
Corporation; and

WHEREAS, Lennar Homes, Inc., has requested an assignment of the Water and
Sewer Developer's Agreement to Leisure Colony Management Corporation; and
WHEREAS, pursuant to Part IV(A) of the Water and Sewer Developer's Agreement
for the Kings Point Commercial Plaza Project, the City of Tamarac shall approve all
assignments of the Water and Sewer Developer's Agreements; and
WHEREAS, pursuant to Part IV(A) of the Water and Sewer Developer's Agreement,
the City shall be a party to said assignment; and
WHEREAS, it is the recommendation of the Director of Utilities that the Assignment
and the Acceptance and Acknowledgment of Agreement and Consent to Assignment be
approved; and that the Acknowledgment of Agreement and Consent to Assignment of the
Water and Sewer Developer's Agreement between Lennar Homes, Inc., and Leisure
Colony Management Corporation be approved and executed; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to: 1) Approve the Assignment; 2) Approve the Acknowledgment
and Consent to Assignment; and 3) Approve and execute the Acceptance and
Acknowledgment of Agreement and Consent to Assignment of the Water and Sewer

Developer's Agreement between Lennar Homes, Inc., and Leisure Colony Management
Corporation for the Kings Point Commercial Plaza Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That the City of Tamarac hereby approves and accepts the
Assignment of the Water and Sewer Developer's Agreement executed by Lennar Homes,
Inc., (attached hereto as "Exhibit 2") for the Kings Point Commercial Plaza Project located
on the southeast corner of Nob Hill Road and NW 77`h Street.
SECTION 3: That the City of Tamarac hereby approves the Acceptance and
Acknowledgment of Agreement and Consent to Assignment executed by Leisure Colony
Management Corporation, (attached hereto as "Exhibit 3")
SECTION 4: That the City of Tamarac hereby approves and authorizes the
appropriate City Officials to execute the Acknowledgment of Agreement and Consent to
Assignment of the Water and Sewer Developer's Agreement for the Kings Point
Commercial Plaza Project (attached hereto as "Exhibit 4")
SECTION 5: That the Assistant City Clerk is hereby authorized and directed

to record said agreements in the public records of Broward County.
SECTION 6: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 7- If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 8: This Resolution shall become effective immediately upon its
passage and adoption.

AND CONSENT TO ASSIGNMENT

Name of Development
The City of Tamarac, a municipal corporation of the State of Florida, "City", hereby
acknowledges that effective as of June 12. 1996 , it entered into a Water and Sewer
Developer's Agreement concerning Kings Point Commercial Plaza , "Developer's
Agreement", with Lennar Homes Inc. as Developer, a copy of which Agreement is
incorporated by reference.
The Developer's Agreement was subsequently assigned by Lennar Homes, Inc., to
Leisure Colony Management Corporation ,by Assignment dated December 15 1997
The City hereby consents to and approves the Assignment of the Developer's
