R-98-�5 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE TERMS OF EMPLOYMENT FOR CITY MANAGER ROBERT S. NOE, JR., AS HAVE BEEN SET FORTH IN RESOLUTIONS NO. R-94-34 AND R-96-95; PROVIDING FOR AN INCREASE IN SALARY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Robert S. Noe, Jr., has been employed as City Manager since February 28, 1994; and WHEREAS, the salary of the City Manager is fixed by the City Commission pursuant to Tamarac Charter section 5.02(c); and WHEREAS, Robert S. Noe, Jr. underwent a review on February 9, 1998; and WHEREAS, the City Commission desires to provide a merit increase of five (5%) percent and a cost of living increase of four (4%); and WHEREAS, these increases will result in the City Manager's salary to be set at One Hundred Three Thousand Seven Hundred Forty Dollars ($103,740.00) per year effective January 1, 1998, payable in twenty-six (26) equal installments at such pay periods as all 1 Temp. Reso. # 8144 2 02/23/98 1 other City employees are paid; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac that City Manager Robert S. Noe, Jr., receive a salary of One Hundred Three Thousand Seven Hundred Forty Dollars ($103,740.00) per year effective January 1, 1998, to be evaluated annually. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing 'WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That City Manager Robert S. Noe, Jr., receive a salary of One Hundred Three Thousand Seven Hundred Forty Dollars ($103,740.00) per year effective January 1, 1998, to be evaluated annually. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 Temp.
