R-98- T A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE TWO SUBMERSIBLE PUMPS FROM ABS PUMPS, INC., A SINGLE SOURCE SUPPLIER, AT A COST NOT TO EXCEED $13,400; APPROVING FUNDING FROM THE APPROPRIATE UTILITY OPERATING ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has a number of wastewater pump stations, including Pump Stations 2A and 35; and WHEREAS, each of these pump stations is a duplex station, which means that there are two submersible pumps in each station; and WHEREAS, the existing submersible pumps in each station were manufactured by ABS Pumps, Inc.; and and WHEREAS, one of the submersible pumps in each station needs to be replaced; WHEREAS, in order to ensure proper operation with the remaining pumps, to minimize spare parts inventory, and to eliminate any need for pump station retrofitting to accept a different pump manufacturer, it is recommended that the new submersible pumps be manufactured by ABS Pumps, Inc.; and Temp. Reso. #8097 December 29, 1997 2 WHEREAS, ABS Pumps, Inc., complies with the Utilities Department Standard Bid Specifications as approved products for wastewater pump stations; and WHEREAS, Section 6-151(3) of the Tamarac City Code allows for the exception to bid requirements for equipment in excess of $10,000.00 when available from only one (1) source; and WHEREAS, There is only one (1) source for ABS pumps in Florida, as documented by "Exhibit A"; and WHEREAS, the Director of Utilities recommends the purchase of two submersible pumps from ABS Pumps, Inc., at a cost not to exceed $13,400 be approved; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of Tamarac, Florida, to purchase two submersible pumps from ABS Pumps, Inc., at a cost not to exceed $13,400. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That the appropriate City Officials are hereby authorized to purchase two pumps at a cost not to exceed $13,400 from ABS Pumps, Inc. Temp. Reso. #8097 December 29, 1997 3 SECTION 3: That funding is approved from the appropriate Utility Operating Account. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. We are located approximately 35 miles northeast of Orlando in Orange City. We are also the sole source in Florida for ABS equipment, parts, and service. A complete inventory of pumps and replacement parts is maintained at our Orange City facility where we provide full in-house factory service and field service with our fleet of three service trucks. We also provide weekly pickup and delivery of pumps requiring factory service. All service, including motor rewinds, is done in-house by factory trained personnel.
