RESOLUTION NO. R-96- 163
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA, FOR
THE VACATION OF RIGHT-OF-WAY (R.O.W.)
OF A PORTION OF PARCEL "A", LAND
SECTION 8, OF THE PLUM HARBOR
REPLAT IN ORDER TO BE CONSISTENT
WITH -THE PREVIOUSLY APPROVED
REVISED SITE DEVELOPMENT PLAN
ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 154, PAGE 48
OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; PETITION NO. 2-P-96;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Right -of -Way (R.O.W.) described in Exhibit "A" (attached hereto)
was dedicated to the public on October 5,1993 at the time of the initial recordation of the
Plat; and
WHEREAS, the property owner, Pulte Home Corporation, has requested the
vacation of Right -of -Way (R.O.W.) of a portion of Parcel "A", Land Section 8, of the Plum
Harbor Replat in order to be consistent with the previously approved revised site
development plan for the property; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of the Right -of -Way (R.O.W.);

WHEREAS, the Planning Commission recommended approval on April 17, 1996;
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate the Right -
of -Way (R.O.W.) of a portion of Parcel "A", Land Section 8, of the Plum Harbor Replat; and
WHEREAS, the property owner, Pulte Home Corporation, will provide additional
Right -of -Way in order to be consistent with the previously approved revised site
development plan for the property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The dedicated Right-of-way (R.O.W.) of a portion of Parcel "A",
Land Section 8, of the Plum Harbor Replat, according to the Plat thereof as recorded in
Plat Book 154, Page 48, of the Public Records of Broward County, Florida, Petition No. 2-
P-96 (described in Exhibit "A"); is hereby vacated.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

A portion of that Right -of -Way granted to the city of Tamarac by
that Right -of -Way Deed recorded in Official Records Book 21840,
Page 799 of the Public Records of Broward County, Florida also
being a portion of Parcel "A", LAND SECTION B. according to the
Plat thereof, as recorded in Plat Book 154, Page 48, of the
Public Records of Broward County, Florida, described as follows:
COMMENCING at the Northwest corner of said Parcel "A";
THENCE North 89036'02" East along the North line of said Parcel
"A", 146t.41 feet;
THENCE South 01*26'21' East, 340.51 feet to the Point of Curvature
of a curve concave to the Northeast and the POINT OF BEGINNING;
THENCE Southeasterly, along the arc of said curve having a radius
of 25.00 feet, a delta of 88" 57' 37" , and an arc distance of 38.82
Feet to a Point of Cusp;
THENCE South 89°36'02" West, a distance of i0O.02 feet to a Point
Of Cusp of a curve concave to the Northwest;
THENCE Northeasterly, along the arc of said curve having a radius
of 25.00 feet, a delta of 91' 02' 23" , and an arc distance of 39.72
feet;
THENCE South 89021'38" East, 50.03 feet to theHP01NT OF BEGINNING.
Said lands lying In the City of Tamarac, Broward County, Florida
containing 1519 square feet, more or less.
