R-96- 163 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, FOR THE VACATION OF RIGHT-OF-WAY (R.O.W.) OF A PORTION OF PARCEL "A", LAND SECTION 8, OF THE PLUM HARBOR REPLAT IN ORDER TO BE CONSISTENT WITH -THE PREVIOUSLY APPROVED REVISED SITE DEVELOPMENT PLAN ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 154, PAGE 48 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; PETITION NO. 2-P-96; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Right -of -Way (R.O.W.) described in Exhibit "A" (attached hereto) was dedicated to the public on October 5,1993 at the time of the initial recordation of the Plat; and WHEREAS, the property owner, Pulte Home Corporation, has requested the vacation of Right -of -Way (R.O.W.) of a portion of Parcel "A", Land Section 8, of the Plum Harbor Replat in order to be consistent with the previously approved revised site development plan for the property; and WHEREAS, the City Engineer and franchised Utility Companies have been contacted and all have stated no objection to the vacation of the Right -of -Way (R.O.W.); and and Temp. Reso. #7406 2 April 23, 1996 Revision No. 1 - April 25, 1996 WHEREAS, the Planning Commission recommended approval on April 17, 1996; WHEREAS, the Director of Community Development recommends approval of this request; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to vacate the Right - of -Way (R.O.W.) of a portion of Parcel "A", Land Section 8, of the Plum Harbor Replat; and WHEREAS, the property owner, Pulte Home Corporation, will provide additional Right -of -Way in order to be consistent with the previously approved revised site development plan for the property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The dedicated Right-of-way (R.O.W.) of a portion of Parcel "A", Land Section 8, of the Plum Harbor Replat, according to the Plat thereof as recorded in Plat Book 154, Page 48, of the Public Records of Broward County, Florida, Petition No. 2- P-96 (described in Exhibit "A"); is hereby vacated. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 1 1 Temp. Reso. #7406 3 April 23, 1996 Revision No. 1 - April 25, 1996 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
