Reso. #7418 May 8, 1996 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; APPROVING A MINOR DELEGATION REQUEST TO INCLUDE AN ADDITIONAL 3,636 SQUARE FEET OF COMMERCIAL IN THE NOB HILL/WESTWOOD PLAT, PARCEL "B", ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 144, PAGE 3, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; LOCATED IN THE POINT PLAZA SHOPPING CENTER AT THE NORTHEAST CORNER OF NOB HILL ROAD AND WESTWOOD DRIVE; CASE NO. 17-P-95; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has examined the application and staff recommendation dated May 22, 1996; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan for the development that is the subject of the application; and WHEREAS, at the time the plat was recorded, Broward County did not have the benefit of a conceptual site plan for the proper determination of commercial square footage; and WHEREAS, the property owner desires to include an additional 3,636 square feet of commercial in the Nob Hill/Westwood Plat located in the Point Plaza Shopping Center at the northeast corner of Nob Hill Road and Westwood Drive; and WHEREAS, the Planning Commission recommended approval on May 1, 1996; and WHEREAS, the Director of Community Development recommends approval; and 1 1 1 Temp. Reso. #7418 2 May 8, 1996 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this delegation request; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby approves the delegation request to include an additional 3,636 square feet of commercial in the Nob Hill/Westwood Plat, Parcel "B", according to the Plat thereof, as recorded in Plat Book 144, Page 3, of the Public Records of Broward County, Florida; located in the Point Plaza Shopping Center at the northeast corner of Nab Hill Road and Westwood Drive. The plat notation being amended reads as follows: This Plat is restricted to 74,896 square feet of commercial on Parcel "A" and 28,740 square feet of commercial on Parcel "B". This note is required by Chapter 5, Article IX, Broward County Code of Ordinances, and may be amended by approval of the Broward County Board of County Commissioners. The Notation and any amendments thereto are solely indicating the approved development level for property located within the Plat and do not operate as a restriction in favor of any property owner including an owner or owners of property within this Plat who took title to the property with reference to this Plat. Temp. Reso. #7418 3 May 8, 1996 1 SECTIONS All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4_ If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5s This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 1 ATTEST: CAROL A.
