RESOLUTION NO. R-96---F
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA, FOR
THE VACATION OF A TWENTY-FIVE FOOT
(25') DRAINAGE EASEMENT IN ORDER TO
FACILITATE DEVELOPMENT OF THE
PROPERTY WITHIN THE INTERIOR OF A
PORTION OF PARCEL "S", "KINGS POINT
REPLAT", ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK
156, PAGE 3 OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; PETITION
NO. 4-P-96; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FQR AN ELECTIVE DAZE.
WHEREAS, the drainage easement described in Exhibit "A" (attached hereto) was
dedicated to the public on October 25,1991 at the time of the initial recordation of the Plat;
and
WHEREAS, the property owner, Lennar Homes, Inc., has requested the vacation
of a twenty-five foot (25) drainage easement in order to facilitate development of the
property within the interior of a portion of Parcel "S", "Kings Point Replat", according to the
Plat thereof, as recorded in Plat Book 156, Page 3 of the Public Records of Broward
County, Florida; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of the drainage easement; and

WHEREAS, the Planning Commission recommended approval on April 17, 1996;
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the vacation
of a twenty-five foot (25') drainage easement in order to facilitate the development of the
property within the interior of a portion of Parcel "S", "Kings Point Replat".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The twenty-five foot (25) drainage easement in order to
facilitate development of the property within the interior of a portion of Parcel °S", "Kings
Point Replat", according to the Plat thereof as recorded in Plat Book 156, Page 3, of the
Public Records of Broward County, Florida; Petition No. 4-P-96 (described in Exhibit "A");
is hereby vacated.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

LEGAL DESCRIPTION
A 25-FOOT WIDE STRIP IN PARCEL "S", "KINGS POINT REPLAT", ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 156, PAGE 3, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, THE
CENTERLINE OF WHICH IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF THE TRAFFIC CONTROL EASEMENT IN SAID PARCEL -S"
AS SHOWN ON SAID PLAT; THENCE SOUTH 81' 16'20" EAST, A DISTANCE OF 12.00 FEET TO A POINT
ON THE ARC OF A CIRCULAR CURVE TO THE LEFT AT WHICH THE RADIUS POINT BEARS SOUTH
82' 25'25" EAST; THENCE SOUTHERLY ALONG THE ARC OF SAID CURVE, HAVING A RADIUS OF 2453.00
FEET AND A CENTRAL ANGLE OF 00921'40", A DISTANCE OF 15.45 FEET TO THE POINT OF BEGINNING
(THE LAST TWO DESCRIBED COURSES BEING COINCIDENT WITH THE EAST BOUNDARY OF SAID PARCEL
"S"); THENCE NORTH 86'49'58" WEST, ALONG A LINE NON -RADIAL TO THE LAST DESCRIBED CURVE, A
DISTANCE OF 115.21 FEET; THENCE NORTH 89055'30" WEST, A DISTANCE OF 106.25 FEET; THENCE
