R-96- 10?6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA ENCOURAGING GOVERNOR LAWTON CHILES TO VETO HOUSE BILL 557 "PROPERTY APPRAISERS PRESUMPTION OF CORRECTNESS", THIS LEGISLATION MAY INCREASE EXPENSES AND DECREASE PROPERTY TAX REVENUES TO THE STATE OF FLORIDA, BROWARD COUNTY AND THE CITY OF TAMARAC; THIS LEGISLATION DIRECTLY IMPACTS TAMARAC, AND THE CITY OF TAMARAC DEEMS IT TO BE AN UNFUNDED MANDATE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN-EFFEQTIVE DATE. WHEREAS, the current Property Appraiser's Presumption of Correctness provides necessary ad valorem taxes to the State of Florida, Broward County, and the City of Tamarac; and WHEREAS, the current administrative and judicial appeals processes pertaining to property valuation is fair to all taxpayers; and WHEREAS, the current Property Appraiser's review process provides presumption in favor of the taxpayer using standards of evidence; and WHEREAS, property owners who now dispute this assessment have resources in a three stop appeals process: Office. 1. An informal meeting between the property owner and the Property Appraiser's 2. An appeal to the Value Adjustment Board. 3. Either the property owner or the Property Appraiser may file a lawsuit; and WHEREAS, a majority of valuation disputes are resolved without resorting to a lawsuit; and 2 Temp. Reso. #7432 Revision #1 5/21 /96 Revision #2 5/21/96 WHEREAS, House Bill #557, "Property Appraiser's Presumption of Correctness" would lower the evidence procedure required in court which would increase the cost of litigating appeals; and WHEREAS, an increase in the cost of litigating appeals would have severe financial impacts to current and future state, and county budgets and could jeopardize the overall rate structure of the ad valorem tax collection process; and WHEREAS, any increase in expenses or decrease in property tax revenues caused by this legislation is deemed by the City of Tamarac to be an UNFUNDED MANDATE; and WHEREAS, the Broward League of Cities, in cooperation with the Florida League of Cities has requested all Broward municipalities to encourage Governor Lawton Chiles to Veto House Bill 557, "Property Appraiser's Presumption of Correctness"; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to encourage Governor Lawton Chiles to Veto House Bill 557, "Property Appraiser's Presumption of Correctness". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: B=IQN 1 : That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City of Tamarac encourages Governor Lawton Chiles to Veto House Bill 557, "Property Appraiser's Presumption of Correctness". SECTIQLI 3: That the City Clerk is hereby authorized and directed to send copies of this resolution to the Governor, the Florida League of Cities, and the Broward League of Cities. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby 3 Temp. Reso. #ZA32 Revision #1 5/21/96 Revision #2 5/21/96 repealed to the extent of such conflict. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
