RESOLUTION NO. R-96 - 134P
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING THE RENEWAL OF
BROWARD COUNTY CO-OP CONTRACT #D-12-95-04-21
"GASOLINE AND DIESEL FUELS;" AUTHORIZING THE
PURCHASE OF GASOLINE AND DIESEL FUELS IN THE
AGGREGATE AMOUNT OF $83,000 FUNDED FROM THE
FLEET SERVICES FUND AND UTILITIES WEST
OPERATING FUND; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, gasoline and diesel fuels are necessary in order to operate City
vehicles; and
WHEREAS, Broward County has renewed Co-op Bid #D-12-95-04-21 awarded to
BP Oil, Inc. for gasoline and Truman Arnold Companies for diesel fuel for a two-year
period. Bid renewal is for the period starting May 1, 1996 and terminates on January 31,
1998; and
WHEREAS, City Code §6-155 allows the Purchasing Officer the authority to join
with other units of government in cooperative purchasing when the best interest of the City
would be served; and
WHEREAS, it is the recommendation of the Director of Public Works and the
Purchasing Officer that Broward County Co-op Bid #D-12-95-04-21 be renewed; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to purchase gasoline
from BP Oil Company and diesel fuel from Truman Arnold Companies.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTIQN 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: That the appropriate City Officials are hereby authorized to
purchase gasoline from BP Oil Company and diesel fuel from Truman Arnold Companies
under Broward County Co-op Contract #D-1 2-95-04-2 1, Exhibit A.
SECTION 3: That the purchase of gasoline and diesel fuels is hereby
authorized in the amount of $80,000 from the Fleet Services Fund and in the amount of
$3,000 from the Utilities West Operating Fund.
SECTIQN 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTIQ„N 5: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.

responsive and responsible bidders and I am recommending that the ,award be
made to these bidders, subject to the following indicated contingencies:
CONTINGENCIES:
XX USERS' CONCURRENCE: A Memorandum of Concurrence is being requested of
the user(s) as to concurring with the award to the recommended vendor.
User is to take into consideration, that vendor's bid must satisfy all
the requirements of the specifications. If not concurring with this
recommendation, the user is requested to fully explain why the bidder
has not specifically met/complies with all the requirements of the bid
specification. A copy of the form "Memorandum of Concurrence" has been
attached to a copy of this Recommendation for Award to bra completed by
the user and to be returned to the Purchasing Division within three (3)
working days of the date of this recommendation.

THE USING DIVISIONS AND THE PURCHASING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
ADDITIONAL INFORMATION:
This is a Broward Co-operative (co-op) Contract with twenty-six (26) participating
agencies for which Broward County is acting as the Lead Agency. As the head Agency
Broward County provides the administrative function of soliciting and evaluating bids
and in initiating the award(s). Each participating agency is responsible for making
their own award(s) in accordance with the initiating award of the Lead Agency.
The dollar value stated in the Motion to Award is the Broward portion of the Co-op
Contract. special Instructions, Section 1.3. specifies that the quantities projected
for the Co-op are for one (1) year, and that the'actual award is for twenty-one (21)
months period. The bid tabulation has been calculated for twenty-one (21) months to
reflect the tenure of this contract. The duration of this contract was specified at
twenty-one (21) months to coincide with the expiration of another contract for diesel
fuel. The quantities of these contracts will be combined in order to entice lower bid
prices.
Item 8 is not being awarded.
An award by Groups (award of all items within the group to one bidder) was specified in
the terms of the bid. By grouping item with similar requirements, a greater quantity
is offered to the bidders. with the economies of scale (larger quantities), the
bidders are able to offer lower bid prices.
