R-96- 137 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT AND EXECUTE AN AGREEMENT WITH DAVID M. GRIFFITH AND ASSOCIATES, LTD. TO CONDUCT A USER FEE STUDY, IN THE AMOUNT OF $33,400, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a User Fee Study identifies all City operations where user fees are currently charged to determine if the fees charged recover the full costs of services; and WHEREAS, a comprehensive review of the City's charges for services (user fees) has not been performed in more than ten years and is required to ensure an adequate fee structure and user charge policies; and WHEREAS, the study will accomplish the following objectives: (1) identify all City operations where user fees are currently charged to determine if the fees charged recover the full cost of service; (2) determine the full cost, direct and indirect, of the service for which fees are charged; (3) identify the authority for each user fee and the current level of subsidization by the City; (4) identify services currently being performed by the City for which a charge for service or other revenue option might be appropriate if services directly accrue to or benefit an individual(s) or group(s); (5) identify and create revenue enhancement ideas which might be appropriate for consideration; and (6) develop a method and policy of annually updating the City's user fees, as well as development of other revenue policies in the interest of the City organization; and WHEREAS, the Finance Department solicited informal proposals from qualified firms through a Request for Proposal publicly advertised on May 3 and May 10, 1996; and WHEREAS, two consulting firms, Vertex and David M. Griffith & Associates, Ltd., responded to the City's Request for Proposal; and WHEREAS, the User Fee Study Committee reviewed and evaluated the proposals; and WHEREAS, the committee considered experience, project organization and understanding, references, cost of services, and other intangibles in the proposals; and WHEREAS, it is the recommendation of the City Manager and Director of Finance that David M. Griffith & Associates, Ltd. be authorized to conduct a User Fee Study, in the amount of $33,400; and Revised May 31, 1996 Temp. Reso. 7364 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City officials to accept and execute an agreement with David M. Griffith and Associates, Ltd. to prepare a comprehensive User Fee Study. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. SECTION 2: The appropriate City officials are hereby authorized to accept and execute an agreement (attached hereto as exhibit A) with David M. Griffith and Associates in the amount of $33,400 to conduct a service cost evaluation and user fee study with an option in the future for an alternative financing study. SECTION 3, All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this resolutions is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this resolution. Griffith & Associates, Ltd. (hereinafter referred to as the "Consultant") and the City of Tamarac, State of Florida (hereinafter referred to as the "City"), WITNESSETH THAT: WHEREAS, the City desires a service cost evaluation be prepared to document the cost of providing services for which service costs are, or could be assessed; and WHEREAS, the Consultant is staffed with personnel knowledgeable and experienced in the requirements of developing and negotiating such service cost • evaluations. NOW THEREFORE, the parties hereto mutually agree as follows: 1. Employment of consultant. The City agrees to engage the Consultant and the Consultant hereby agrees to perform the services as outlined in Attachment A. These services will include a User Fee Study and an Alternative Financing Study, at the option of the City. 2. Time, of Performame. The services to be performed hereunder by the Consultant shall be undertaken and completed in such sequence as to assure their expeditious completion and best carry out the purposes of the agreement. The project will be started within 15 days after notice by the City to proceed and a draft will be delivered to the City within 60 days of project initiation. 3. Compensation. The City agrees to pay the Consultant a total sum of $33,400 for Phase I (User Fee Study) of the engagement. 0 If the City decides to engage the consultant for Phase II (Alternative Financing Study) of this engagement, the fee will be $8,500. This Phase of the Project is optional and will only be done upon notice from the City. 4. Changes. The City may, from time to time, require changes in the scope of the services of the Consultant to be performed hereunder. Such changes, which are mutually agreed upon by and between the City and the Consultant, shall be incorporated in written amendment to this agreement. 5. Serviaes-and Materials to be Furnished by the City. The City shall locally furnish the Consultant with all available necessary information, data, and material pertinent to the execution of this agreement. The City shall cooperate with the Consultant in carrying out the work herein and shall provide adequate staff for liaison with the Consultant and other agencies of City government. 6. Termination of Agreement for Cause. The City shall have the right to terminate this agreement by giving written notice to the Consultant to such termination and specifying the effective date thereof. The Consultant shall be entitled to payment for services rendered to and accepted by the City through the effective date of the termination. 7. Information and Reports. The Consultant shall, at such time and in such form as the City may require, furnish such periodic reports concerning the status of the project, such statements, certificates, approvals and copies of proposed and executed plans and claims and other information relative to the project as may be requested by the City. B. Paymeat_fa Services. The Consultant will invoice sixty percent (60%) of the Contract amount within thirty (30) days, thirty percent (30%) within sixty (60) days, and ten percent (10%) upon acceptance of the final drafts. Should the City elect to have Phase II of this engagement performed, that phase will be billed in the same manner. 0 9. Notices.
