R-96-IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, PROVIDING FOR THE ADOPTION OF THE EVALUATION AND APPRAISAL REPORT (EAR) FOR THE CITY OF TAMARAC, FLORIDA; PROVIDING FOR THE ADOPTION OF THE RECOMMENDATIONS; PROVIDING FOR THE ACKNOWLEDGMENT THAT THE SUPPORTING DOCUMENT ENTITLED, "TAMARAC COMPREHENSIVE PLAN: EVALUATION AND APPRAISAL REPORT", EXISTS AND IS AVAILABLE FOR INSPECTION; PROVIDING FOR THE PREPARATION AND FUTURE ADOPTION OF AMENDMENTS TO THE COMPREHENSIVE PLAN AND THE LAND DEVELOPMENT CODE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida has mandated Comprehensive Planning by Florida municipalities in accordance with the Local Comprehensive Planning and Land Development Regulation Act of 1985 amended ; and WHEREAS, the State of Florida has implemented Florida Administrative Code Rule 9J-5 which sets forth comprehensive planning requirements for local governments ; and WHEREAS, Broward County is a charter County which requires that the Tamarac Comprehensive Plan be consistent with the Broward County Land Use Plan and that Temp. Reso. #7444 2 Revision No. 1 - June 5, 1996 Revision No. 2 - June 6, 1996 certain goals, objectives and policies as well as implementation language be included in the plan; and WHEREAS, the City of Tamarac is a charter City which has comprehensive planning powers; and WHEREAS, the City of Tamarac wishes to preserve the health, safety, welfare, comfort, good order, appearance, convenience, law enforcement and fire prevention, and general welfare of the residents and corporate citizens of the City by adoption of the Evaluation and Appraisal Report (EAR); and WHEREAS, the City of Tamarac wishes to protect and enhance the City's present advantages; and WHEREAS, the City of Tamarac wishes to encourage the most appropriate use of land, water, and other resources consistent with the public interest; and WHEREAS, the City of Tamarac wishes to deal effectively with future problems that may result from the use and development of land within the City of Tamarac; and WHEREAS, the City of Tamarac wishes to prevent the overcrowding of land and the undue concentration of population; and WHEREAS, the City of Tamarac wishes to facilitate the adequate and efficient provision of transportation, water, sewerage, schools, parks recreational facilities, housing, and other requirements and services; and 1-1 Temp. Reso. #7444 3 Revision No. 1 - June 5, 1996 Revision No. 2 - June 6, 1996 WHEREAS, the City of Tamarac wishes to conserve, develop, utilize and protect natural resources within the City of Tamarac; and WHEREAS, the Evaluation and Appraisal Report (EAR) has been prepared in accordance with Chapter 163.3191 of the Florida Statutes professional planning practices; and WHEREAS, the Evaluation and Appraisal Report (EAR) is based on data, facts, estimates and projections in the City of Tamarac Comprehensive Plan; and WHEREAS, the City of Tamarac acknowledges that the supporting document entitled, "Tamarac Comprehensive Plan: Evaluation and Appraisal Report" exists and is available for inspection; and WHEREAS, the City of Tamarac hereby adopts the Evaluation and Appraisal Report (EAR) as attached hereto as Exhibit "A"; and WHEREAS, the City of Tamarac Planning Commission as the Local Planning Agency held a public hearing on June 5, 1996; and WHEREAS, a public hearing concerning the Evaluation and Appraisal Report (EAR) has been held by the City Commission of the City of Tamarac on June 12, 1996; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to adopt the Evaluation and Appraisal Report (EAR). * EXHIBIT A - Evaluation and Appraisal Report (EAR) can be found in the official records of the City Clerk. Reso. #7444 4 Revision No. 1 - June 5, 1996 Revision No. 2 - June 6, 1996 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECIIQN1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 2: The City of Tamarac hereby adopts the Tamarac Comprehensive Plan: Evaluation and Appraisal Report (EAR); including all the recommendations of the Evaluation and Appraisal Report (EAR). A copy of the Tamarac Comprehensive Plan: Evaluation and Appraisal Report (EAR) is attached hereto as Exhibit «A„ SECTION 3: The City of Tamarac hereby acknowledges that the supporting document entitled, "Tamarac Comprehensive Plan: Evaluation and Appraisal Report" exists and is available for inspection. SECTION 4: The adoption of this Evaluation and Appraisal Report (EAR) provides for the preparation and future adoption of amendments to the Comprehensive Plan and the Land Development Code. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If, any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or 1 Temp.
