CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-96 I NZ'
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ENTER INTO AN
AGREEMENT WITH SHEDS AMERICA, INC., A SOLE
SOURCE PROVIDER, TO PURCHASE A HERBICIDE SHED
WITH CONTAINMENT FLOOR AT A TOTAL COST OF
$13,833, WITH FUNDING FROM THE STORMWATER FUND
AND A TRANSFER OF $3,750 FROM THE GENERAL FUND;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Stormwater Utility Division of the Public Works Department is
desirous of centralizing the storage of herbicides into one building; and
WHEREAS, the Recycling Coordinator, is desirous of retrofitting one of the existing
herbicide sheds to a recycling storage facility; and
WHEREAS, it is the recommendation of the Public Works Director, Stormwater
Utility Engineer, Recycling Coordinator, and the Purchasing Officer that the City of
Tamarac purchase from Sheds America, Inc. a herbicide shed with containment floor; and
WHEREAS, Sheds America, Inc. is the sole provider for herbicide sheds with
containment floor; and
WHEREAS, Section 6-151 (3) of the City Code of the City of Tamarac requires sole
source purchases in excess of $10,000 to be approved by the City Commission ; and

WHEREAS, a Budget Transfer of $3,750 is required from the General Fund to the
Stormwater Fund to purchase the herbicide shed; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
purchase of a herbicide shed with containment floor from Sheds America, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The appropriate City Officials are hereby authorized to enter
into agreement with Sheds America, Inc. to purchase a herbicide shed with containment
floor, at a total cost of $13,833. to. A copy of the agreement is attached to this Resolution
as Exhibit "A".
SECTION 3: The appropriate City Official is authorized to prepare a Budget
Transfer of $3,750 from the General Fund to the Stormwater Fund to purchase the
herbicide shed.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part of application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

7. Sheds America Is not responsible for damages to septic tanks, drain fields,

accounts more than 30 days past due will accrue interest at the rate of 1 - 1/2%
per month.
