R-96- AW A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING APPROVAL TO DONG HUONG VIETNAMESE RESTAURANT LOCATED AT 6670 NW 57 STREET, FOR A WAIVER TO REDUCE THE NUMBER OF GARBAGE AND REFUSE COLLECTIONS DUE TO A FINANCIAL HARDSHIP FROM SIX (6) TO NOT LESS THAN THREE (3) TIMES PER WEEK FROM JUNE 1 TO OCTOBER 1; PROVIDING FOR CONDITIONS OF APPROVAL; CASE NO. 17-Z-96; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac, Florida currently regulates the standards for garbage and refuse collection for food service establishments and recognizes that these standards be reviewed and updated; and WHEREAS, the City Commission has enacted Chapter 19 which sets forth stringent garbage and refuse collection and disposal requirements before the issuance of occupational licenses for food service establishments; and WHEREAS, the City Commission of the City of Tamarac, Florida can set minimum requirements for garbage and refuse collections for certain food service establishments in order to protect the health, safety and welfare of its residents; and Temp. Reso. #7473 2 June 26, 1996 Revision No. 1 - July 2, 1996 Revision No. 2 - July 3, 1996 Revision No. 3 - July 3, 1996 WHEREAS, representatives of the Dong Huong Vietnamese Restaurant have stated that the restaurant will be reducing its operating hours for the Summer months; and WHEREAS, the Director of Community Development has reviewed Chapter 19, Article I, Section 19-2(b)(b) which sets forth the provisions by which certain food service establishments can request temporary relief from garbage and refuse upon providing proof of financial hardship; and WHEREAS, the Director of Community Development has reviewed and recommends approval of the request by Dong Huong Vietnamese Restaurant for a reduction in the number of garbage and refuse collections due to a financial hardship from six (6) times to not less than three (3) times per week from June 1 to October 1; providing for conditions of approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the request by Dong Huong Vietnamese Restaurant for a reduction in the number of garbage and refuse collections due to a financial hardship from six (6) times to not less than three (3) times per week from June 1 to October 1, 1996. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 L_J Temp. Reso. #7473 3 June 26, 1996 Revision No. 1 - July 2, 1996 Revision No. 2 - July 3, 1996 Revision No. 3 - July 3, 1996 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION Z That the request by Dong Huong Vietnamese Restaurant for approval to reduce the number of garbage and refuse collections due to a financial hardship from six (6) times per week to not less than three (3) times per week from June 1 to October 1, is hereby approved. Conditions of Approval: 1. The approval shall not apply to peak business operating months (October 2- May 31). 2. The approval shall be for the reduced schedule of restaurant operation from June 1 to October 1. 3. The number of garbage and refuse collections shall not be less than three (3) times per week. 4. Proof of the individual dumpster and yard size must be submitted. The dumpster yard size cannot be decreased from the size of the existing dumpster located on the property. 1 17 u Temp. A copy of the current sanitation agreement must be submitted to the Occupational Licensing Division, and it must be kept current at all times. 6. A letter which attests to the Restaurant closure of two (2) weeks or more, during June 1 to October 1, must be submitted to the Occupational Licensing Division thirty (30) days prior to the first closing date. 7. The City reserves the right to rescind approval upon proof of extensive garbage and refuse accumulation between June 1 and October 1. $=ION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
