RESOLUTION NO. R-96-17
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
VACATING A TWENTY-FIVE (25') FOOT
ALLEY EASEMENT LOCATED ON THE
NORTH TWENTY-FIVE (25') FEET OF LOTS
1, 2, 3 AND 4, AND THE NORTH TWENTY-
FIVE (25') FEET OF THE EAST ONE -
HUNDRED TWENTY-FIVE (125') FEET OF
TRACT "A" OF THE TAMARAC BUSINESS
CENTER PLAT, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK
61, PAGE 27 OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; .PETITION
NO. 13-P-95; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFEQJIVE QATE-
WHEREAS, the twenty-five (25') foot Alley Easement described in Exhibit "A" was
dedicated to the public on November 22, 1965 at the time of the initial recordation of the
Plat; and
WHEREAS, the property owner, Atlantic Homestead Village, Inc., has requested
the vacation of the twenty-five (25') foot Alley Easement in order to eliminate conflicts with
future development plans for the property; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of the twenty-five (25') foot Alley
Easement; and
WHEREAS, the Broward County Department of Environmental Engineering has

been contacted and has stated no objection to the vacation of the twenty-five (25') foot
Alley Easement, provided that a twenty-five (25') foot Utility Easement is dedicated to
Broward County to facilitate any future improvements; and
WHEREAS, the property owner, Atlantic Homestead Village, Inc., has agreed to
dedicate a twenty-five (25') foot Utility Easement to Broward County by separate
instrument; and
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate the twenty-
five (25') foot Alley Easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the twenty-five (25') foot Alley Easement located on the
north twenty-five (25) feet of Lots 1, 2, 3 and 4, and the north twenty-five (25') feet of the
east one -hundred twenty-five (125) feet of Tract "A" of the Tamarac Business Center Plat,
according to the Plat thereof as recorded in Plat Book 61, Page 27, of the Public Records
of Broward County, Florida, Petition No. 13-P-95; is hereby vacated.

SECTION 3. All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
b9EQI'Qbl4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
