RESOLUTION NO. R 96- 173
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, DECLARING CERTAIN
EQUIPMENT AND MATERIAL AS SURPLUS AND
DIRECTING THAT AN AUCTION BE HELD; AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO ENTER INTO AN
AGREEMENT WITH J. SUGARMAN AUCTIONEERS TO
CONDUCT THE AUCTION UTILIZING THE TOWN OF
DAVIE'S REQUEST FOR PROPOSAL #B-95-45; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, surplus and obsolete equipment and material has reached a sufficient
level to warrant an auction and;
WHEREAS, pursuant to Section 6-153 of the Code of Ordinances, the City
Commission may by Resolution direct that an auction be held for the sale of surplus and
obsolete equipment and material and;
WHEREAS, pursuant to Section 6-151(2) of the Code of Ordinances, a
professional auctioneer will be utilized to assist in facilitating the auction and;
WHEREAS, on July 5, 1996, the Town of Davie awarded an agreement for
professional auctioneering services to J. Sugarman Auctioneers in response to Davie's
Request for Proposal #13-95-45 and;
WHEREAS, the City of Tamarac will utilize the contract terms of the Town of Davie's
agreement with J. Sugarman Auctioneers and;
WHEREAS, the City Manager and the Interim Purchasing Officer have
recommended that a public auction be held to dispose of the surplus and obsolete
equipment and material and;

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve the
auction for the sale of surplus and obsolete equipment and material and to authorize the
appropriate City officials to enter into an agreement with J. Sugarman Auctioneers to
conduct the auction utilizing the Town of Davie's Request for Proposal #B-95-45.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
Sp,plionThe foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
Section - That the list in Exhibit "A" consisting of surplus and obsolete equipment
and material is declared as surplus.
Section 3: That an auction of the surplus City equipment and material, listed in
Exhibit "A" shall be held as indicated:
WHEN: August 24, 1996
TIME: 10:00 A.M.
WHERE: City of Tamarac
Public Services Administrative Complex
6001 Nob Hill Road
Tamarac, Florida
Section 4: That the items offered for auction will be available for inspection to
the public at the City of Tamarac, Public Services Administrative Complex on the day of
the auction, from 8:00 A.M. to 10:00 A.M. and at Fire Station #1, located at 7501 NW 88th
Avenue, at the same date and time.
Sedon 5: That the City of Tamarac reserves the right to establish a minimum bid
or reject all bids on any or all items.
SQction 6: That the appropriate City officials are hereby authorized to enter into
an agreement with J. Sugarman Auctioneers (attached as exhibit "B") utilizing the Request
for Proposal #13-95-45 from the Town of Davie for Auctioneering Services approved on
July 5, 1996 (attached as exhibit "C").
Section 7: That any unsold items shall be considered as having no cash value
and shall be disposed of in a manner deemed appropriate by the City Manager or
designee.

Section 8: That all proceeds from the auction or disposal shall be placed in the
General Fund to be used for public purposes.
e t' 9: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section_1Q If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 11. This Resolution shall become effective immediately upon its passage
and adoption.

NOTE: AUCTIONEER HAS THE RIGHT
TO CHARGE 10 % BUYERS PREMIUM
WHICH IS THE SOLE POSSESSION
OF THE AUCTIONEER.
This Agreement is a formal request that The Auctioneer will sell for The Vendor by public auction the described inventory of
SURPLUS INVENTORY located at CITY OF TAMARAC, TAMARAC FLORIDA
or any other mutually agreed location onSAT AUG 2 4 , 19 9 6
Vendor agrees to pay all costs of advertising and other mutually agreed expenses in relation to this sale. In addition to the
expenses The Vendor will pay The Auctioneer's commission of —0— % of the gross amount realized at the sale. The
expenses and commissions will be deducted from any monies due The Vendor from the sale conducted by The Auctioneer and
received on behalf of The Vendor.
leII expenses will be evidenced by tear sheets and invoices, labor expense will be evidenced by our invoices. The expenses will be

The Vendor will deposit $ —0— to The Auctioneer in the form of a retainer to cover partial costs of expenses. This
retainer will be deaucted from the total of expenses and commissions due The Auctioneer.
Vendor represents the legal right to authorize this sale and also represents that there are no creditors, or contingent liabilities
and the inventories herein mentioned are free and clear of all encumbrances unless the creditors unsecured or secured are listed
and made a part of this Agreement.
The Vendor agrees to hold The Auctioneer harmless for any damages sustained by The Vendor in the performance of the work
for which the Auctioneer has been engaged, excepting any damages sustained due to the willful misfeasance or malfeasance of
The Auctioneer in the performance of this employment.
The Auctioneer shall carry out all duties and obligations which in his discretion are necessary to conduct, enforce and
effectuate this auction to the best of his ability.
If any property is withdrawn or sold by The Vendor from the sale after The Auctioneer has the items listed or advertised the
Auctioneer shall be entitled to full commission on these items.
The Auctioneer shall have the privilege of charging a Buyer's Premium on any part or the entire sale. (That is an additional charge
to the Buyer). These funds are the sole ownership of The Auctioneer.
The Auctioneer is empowered by The Vendor to render to any buyers at the auction a paid in full bill and transferof title and ownership
of any properties purchased at this Auction.
The Auctioneer will make full settlement with The Vendor within ten working days following the Auction sale.
This agreement contains the entire understanding between the parties hereto and cannot be modified or changed unless

Thank you for the opportunity to submit a proposal to conduct a
professional auction on the Surplus Inventory located at City of
Tamarac.
SITE: It is recommended the auction should be held on the original
site, this brings credibility to the sale.
SA E DATE: The sale date will be determined depending on the type
of equipment. Example: Restaurant Equipment (Tuesday or
Wednesday). Office Machines and Furniture (Wednesday, Thursday or
Saturday). We propose that this Auction be held on Saturday August
24th, 1996 at 10.00 A.M.
ORGANIZATION: JAY SUGARMAN AUCTIONEERS boasts four premier
licensed auctioneers on staff, all of whom are proficient in the
use of the auctioneer chant. Jay Sugarman, president, is a
graduate of the Certified Auctioneers Institute, Indiana
University. Robert Sugarman, Chairman of the Board has been a
professional auctioneer for more than 20 years. Our experience and
expertise in the auction industry has proven successful in the 200
auctions conducted each year for governmental, financial and
business institutions.
We will provide two (2) fully licensed auctioneers and two (2) bid
assistants for the sale. we will have additional staff on hand for
registering bidders, and (1) one cashier for post -auction
activities.

ADVERTISING: Promotional advertising will include, display ads in
the Miami Herald, and Ft. Lauderdale News Sun -Sentinel,
MECHANICS OF AUCTION: All prospective bidders will register with
$100.00 cash deposit at the auction. The deposit is immediately
refunded if no purchase is made.
An inspection period of two hours prior to the auction will allow
registrants to examine the inventory. All Merchandise is sold on
an "as-isff, '$where -is" basis, thus relieving the courts and trustee
of any responsibility upon acceptance of the highest bid.
CHECK-OUT: All inventory will be removed from the premises by 5:00
p.m. the day following the auction or by arrangements. No
merchandise may be removed without a paid receipt from JAY SUGARMAN
AUCTIONEERS, INC.
FEES: JAY SUGARMAN AUCTIONEERS will conduct a professional auction
within the terms of this proposal for a commission of Zero O$ of
gross proceeds plus marketing and advertising expenses including
labor, to be capped at 1,500.00. There will be no other expenses
involved.
SETTLEMENT: JAY SUGARMAN AUCTIONEERS will receive and deposit all
receipts into an escrow account. We will remit net proceeds to you
within ten (10) working days following the auction.
We respectfully submit this proposal secure in the knowledge that

highest financial return available in the market place today.

REQUEST FOR PROPOSAL
l Nature of Proposal
The Town of Davie invites qualified firms to submit a proposal. along with
statements of qualifications and experience, a cast breakdown, terms of sale,
resutrtes of key personnel and a list of at least three (3) references for consideration
to provide au.ctioneering services.
Auctioneers responsibilities shall include but not be limited to:
All advertising to attract potential buyers to the auction
Tagging all items along; with. a representative of the Town on the Thursday and
Friday (if necessary) prier to the auction which will be held on a Saturday.
Providing all necessary personnel for conducting the auction.
Providing the Town with a copy of all sales receipts immediately following the
auction.
Payment to the Town shall be accomplished within ten (10) working days after the
auction.
Follow up with. all buyers to reconcile any outstanding; account, pick up and
removal of any purchases.
ii Selection Process
The Town will accept proposals through Monday, March 20, 1yyS. Proposals will be
reviewed by a Town committee. After review of proposals and prior to final rank-
ing, the committee will conduct interviews with the shortlisted firm(s). Cost of ser-
vices will be considered along; with other criteria listed above. in no event will price
be the sole consideration in selecting the most highly qualified firm. The committee
reserves the right to make its reconintendation based on the best qualified firm in
the sole discretion of the committee.
The committee will make a recommendation to the Town Council, which will make
the final decision by resolution at a future date.
Iii Term of Agreement
The agreement between the Town and the successful bidder will be for conducting
one auction for the Town. This agreement may be renewed for four (4) additional
auctions by mutual agreement of the parties.

IV Submission and Receipt
Interested firers should submit their proposals along with rest.rrnes of key personnel
by 2:00 p.m. on Monday, March 20, 1995.
