R-96- I Te A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CITY MANAGER TO SEND A PROPOSED MILLAGE RATE OF 6.3435 TO THE PROPERTY APPRAISER FOR FISCAL YEAR 1997 AND TO SET A DATE, TIME AND PLACE FOR THE FIRST PUBLIC BUDGET HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statute 200.065 (TRIM - Truth in Millage) requires all municipalities, within 35 days of receipt of certification of value (on or around July 1), to advise the Property Appraiser of an estimated millage rate to be included in the TRIM notice sent to each taxpayer; and WHEREAS, an estimated and tentative millage rate should be proposed which would allow the City Commission latitude in meeting fiscal year 1997 budgetary requirements; and WHEREAS, the estimated and tentative millage rate should be sufficient to cover the revenue projected to be derived from the proposed Fire Rescue Assessment to maintain the City's fiscal flexibility should the Assessment not be approved; and WHEREAS, an estimated and tentative millage rate may be adjusted downward and failure to provide this information prohibits levying a millage rate greater than the rolled -back millage rate; and WHEREAS, Florida Statute 200.065 requires that a hearing date, other than that scheduled by the Broward County Commission and the Broward County School Board, be set by each municipality to be included in the TRIM notice sent to each taxpayer; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to allow the City Manager to send an estimated and tentative millage rate of 6.3435 to the Property Appraiser and to set a date, time, and place for the first public budget hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and TEMP. RESO. # AU Page 2 7/9/96 confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Section 2: The City Manager is authorized to send notification to the Property Appraiser of the estimated millage rate of 6.3435 for fiscal year 1997 along with the date, time and place of the first Public Budget Hearing being Monday, September 9, 1996 at 5:05 P.M. at the City of Tamarac Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321. Section 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable.
