RESOLUTION NO. R-96- 190
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA INCREASING THE MONTHLY RATE
PAID TO SOUTHERN SANITATION FOR RESIDENTIAL
MULTI -FAMILY SOLID WASTE SERVICE $.20 PER CUBIC
YARD EFFECTIVE OCTOBER 1, 1996; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATF:.,.�,,,,___
WHEREAS, the City of Tamarac has a contract with Southern Sanitation for
collection and disposal of solid waste from residential multi -family residences within the
City of Tamarac; and
WHEREAS, Broward County has increased the disposal fee from $77.32 to $79.00
per ton; and
WHEREAS, Broward County mandated that this fee increase would be effective
October 1 st of each year; and
WHEREAS, Article 8.1 of the agreement between the City of Tamarac and Southern
Sanitation for multi -family solid waste collection provides for certain adjustments of the
monthly rates upon notification by Southern Sanitation that Broward County's disposal fees
have increased, a copy of said notice by Southern Sanitation dated August 5, 1996
attached as Exhibit 1"; and
WHEREAS, based on the Broward County disposal fee increase, Southern
Sanitation has requested a monthly rate increase of $.20 per cubic yard for residential
multi -family solid waste service effective October 1, 1996; and

WHEREAS, the City Manager and Assistant City Manager recommend approval;
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to increase the
monthly rate paid to Southern Sanitation for residential multi -family solid waste service by
$.20 per cubic yard effective October 1, 1996.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the monthly rate for providing residential multi -family solid waste
service will be increased by $.20 per cubic yard effective October 1, 1996.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION ' This Resolution shall become effective immediately upon its passage
and adoption.

Waste ManAgement, Inc.
Based on Article 8 of our contract, the monthly rate for providing multifamily solid
waste service will be increased $.20 per yard effective October 1, 1996. The adjustment
was computed as follows:
Broward County's disposal fees, based on the Interlocal Agreement, will
increase from $77.32 to $79.00 per ton. The disposal pass -through
formula in our contract provides for ten cents ($.10) per cubic yard plus
• 15% franchise fee for each one dollar ($1.00) change in the per ton
disposal rate ($1.68 x .10 — .85).

Resource Recovery System Customer
Dear Customer,
The Resource Recovery Board at its last meeting on May 17,
1996, approved an increase in the fee charged For the delivery of
processable waste to the two resource recovery plants` effective
with the fiscal year beginning October 1, 1996.
The fee for processable waste will be increased from $77.32 to
$79.00 per ton or 2%. This is substantially less than inflation.
Inflation during the past year was 2.5% as measured by the Bureau
of Labor statistics Miami -Fort Lauderdale Consumer Price Index.
The Board also amended its Plan of Operation at the same
meeting to include now penalty fees for the misidentification of
the origin of processable waste delivered to one of the Resource
Recovery Plants. The full text of the language added to the Plan
on this matter is enclosed with this notice. We will begin
enforcing this new Plan section on Monday, June 24, 1996.
