R-96- 101 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA INCREASING THE MONTHLY RATE PAID TO ALL SERVICE REFUSE FOR SINGLE FAMILY SOLID WASTE SERVICE FROM $12.92 TO $13.58 PER MONTH AND INCREASING THE COST OF CITY LOGO BAGS FROM $.99 TO $1.05 PER BAG, INCREASES SHALL BE EFFECTIVE OCTOBER 1, 1996; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has a contract with All Service Refuse for collection and disposal of solid waste from single family residences within the City of Tamarac; and WHEREAS, Broward County has increased the disposal fee from $77.32 to $79.00 per ton; and WHEREAS, Broward County mandated that this fee increase would be effective October 1 st of each year; and WHEREAS, Article 3.5 and Article 8.1 of the agreement between the City of Tamarac and All Service Refuse for single family solid waste collections provides for certain adjustments of the monthly rates upon notification by All Service Refuse that the Broward County disposal fee and consumer price index have increased, a copy of said notice by All Service Refuse dated August 29, 1996 is attached as Exhibit "1 "; and WHEREAS, based on the Broward County disposal fee and consumer price index increase All Service Refuse has requested a monthly rate increase of $.66 per month for single family garbage service and an increase of $.06 per City logo bag; and and 2 Temp. Reso. #7504 WHEREAS, the City Manager and Assistant City Manager recommend approval; WHEREAS, the City Commission deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the single family solid rate increase from $12.92 to $13.58 per month and an increase in City logo bags from $.99 to $1.05, increases shall be effective October 1, 1996. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1- That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the monthly rate for providing single family solid waste service will be increased by $.66 per month from $12.92 to $13.58 and the cost of City logo bags will increase by $.06 from $.99 to $1.05, each increase shall be effective October 1, 1996. SECTION 3; All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Andrews Avenue BROMRD COUNTY Fort Lauderdale, FL 33301-1831 _4P (954) 766.4202 • FAX 765.4237 May 30, 1996 Resource Recovery System Customer Dear Customer, The Resource Recovery Hoard at its last meeting on May 17, 1996, approved an increase in the fee charged for the delivery of processable waste to the two resource recovery plants; effective with the fiscal year beginning October 1, 1996. The fee for processable waste will be increased from $77.32 to $79.00 per ton or 2%. This is substantially less than inflation. Inflation during the past year was 2.5% as measured by the Bureau of Labor Statistics Miami -Fort Lauderdale Consumer Price Index. The Hoard also amended its Plan of Operation at the same meeting to include new penalty fees for the misidentification of the origin of processable waste delivered to one of the Resource Recovery Plants. The full text of the language added to the Plan on this matter in enclosed with this notice. We will begin enforcing this new Plan section on Monday, June 24, 1996.
