R-96 - 14 7p A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE ADDENDUM NUMBERS 96-3 AND 96-4 TO THE CONTRACT WITH MONTGOMERY WATSON TO PROVIDE BIDDING SERVICES AND CONSTRUCTION ADMINISTRATION FOR THE INSTALLATION OF WATER AND WASTEWATER UTILITIES ASSOCIATED WITH THE WIDENING OF MCNAB ROAD AND PINE ISLAND FOR A PROPOSED AMOUNT NOT TO EXCEED $53,458 IN ACCORDANCE WITH THE CITY CONSULTING ENGINEERING AGREEMENT AS AUTHORIZED BY RESOLUTION NO. R-96-163 AND APPROVE FUNDING FROM THE APPROPRIATE UTILITIES OPERATIONAL AND CIAC ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Broward County Engineering Division advised the Director of Utilities of the proposed widening of Sections of Pine Island Road and McNab Road; and WHEREAS, Broward County has advised that asbestos concrete pipes (ACP) within those sections of the roadways being widened are required to be replaced in accordance with Broward County road construction standards: and WHEREAS, the Pine Island 16" Water Main was budgeted in the FY95 Utilities Capital Improvement Projects (C.I.P.'s), the Pump Station 25 Force Main Re -Route was budgeted in the FY95 C.I.P.'s, the McNab Road 24" Water Main design was approved by City Commission, all to address the construction required to meet the County road widening schedules and standards; and WHEREAS, City Commission authorized staff to proceed in the design of the Pine Island 16" Water Main and McNab Road 24" Water Main Projects; and �l 1 1 Temp. Reso. 7493 - July 26, 1996 2 Revision #1 - August 19, 1996 WHEREAS, Commission approved Funding in FY95 for construction of the Pine Island 16" Water Main Project; and WHEREAS, the Utilities will be requesting funding for the construction of the McNab Road 24" Water Main to meet the County road widening schedules and standards; and WHEREAS, construction to replace the asbestos cement pipes must be designed and bid so the replacement can start before the road construction begins the first part of 1997; and WHEREAS, funds are available for the costs of the engineering services from the appropriate Utilities Operational and Contribution in Aid of Construction (CIAC) Accounts; and WHEREAS, the Utilities Department has requested Montgomery Watson , one of the City's Consulting Engineers, to present proposals to provide the bidding and construction administration in accordance with the City Consulting Engineering Agreement as authorized by the City on July 10, 1996, Resolution No. R-96-163; and WHEREAS, Montgomery Watson has submitted the following Addendum to the Agreement: D-esgription 1) Addendum No. 96-3, Pine Island 16" Water Main (Lagos De Campo to 57th Street) (bidding services and construction administration) (Attached hereto as "Exhibit 1" and in map form as "Exhibit 2") (Utilities Project No. 95-03) 2) Addendum No. 96-4, McNab Road 24" Water Main Contract (Pine Island to Nob Hill) and Pump Station 25 Force Main Re -Route (bidding services and construction administration) (Attached hereto as "Exhibit 3" and in map form as "Exhibit 4") (Utilities Project Nos. 95-02 and 96-09) TOTAL COMPENSATION Compensation $23,172 $30,286 $53,458; and Temp. Reso. 7493 -July 26, 1996 3 Revision #1 - August 19, 1996 WHEREAS, the costs of the engineering services for the construction documents of the water and wastewater utilities will be funded from the appropriate Utilities Operational and CIAC Accounts; and WHEREAS, it is the recommendation of the Director of Utilities that Addendum Numbers 96-3 and 96-4 providing for the bidding services and construction administration for the asbestos cement pipe replacement projects be approved, executed and funded; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute Addendum Numbers 96-3 and 96-4 to the Engineering Agreement with Montgomery Watson to provide bidding services and construction administration for the installation of water and wastewater utilities associated with the widening of McNab Road and Pine Island for a proposed amount not to exceed $53,458 and to provide for funding from the appropriate Utilities Operational and CIAC Accounts. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SEQT_ION 2: The appropriate City Officials are hereby authorized to accept and execute Addendum Numbers 96-3 for $23,172 and 96-4 for $30,286 to the Engineering Agreement with Montgomery Watson to provide bidding services and construction administration for the installation of water and wastewater utilities associated with the widening of McNab Road and Pine Island for a proposed total amount not to exceed $53,458 in accordance with the City Consulting Engineering Agreement as authorized by Resolution No. R-96-163 on July 10, 1996. 5=10N : That $53,458 is approved to be funded from the appropriate budgeted Utilities Operational and CIAO Accounts. 1 1 Temp. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. It is • understood that said services will be provided in accordance with our City Consulting Engineering Services Agreement with the City, as authorized by the City on July 10, 1996. Except as may be explicitly revised or amended below for application specifically to this Addendum, all provisions of said Agreement shall apply. In accordance with Section 1 of the Agreement, ENGINEER has assigned Job Number 1586.0020 to the task(s) included under this Addendum. The fee breakdown is outlined in Attachment "A". Billing will be in accordance with the Engineering Agreement. 1p.tam.96-3 Page 2 of 10 Addendum No. 96-3 July 24, 1996 i C� City of Tamarac Pine Island Water Main Replacement Task Schedule Task Time of Order General Description Performance Compensation Preamble This is a proposed 16" CIP water transmission line to be located along 88th Avenue between Lagos De Campo Boulevard and Northwest 57th Street, which will replace an existing 12" asbestos cement pipe. The County is widening Pine Island Road in Sunrise. When the widening occurs in Tamarac, all asbestos cement pipe in County road right-of-way must be changed to ductile iron pipe. This project is pre -planning for the County's Pine Island Road widening project scheduled for early 1997. 1. Bidding Services a. Solicitation of Bids. The CONSULTANT shall assist the CITY in advertising for and obtaining bids for each prime contract for construction. Such assistance shall include the scheduling of pre -bid conferences and the attendance at same; the maintenance of a record of all prospective bidders to whom bidding documents have been issued; and the receipt and processing of payment for bidding documents. 1p.tam.96-3 Page 3 of 10 42 days $49400 �e- S -14f ? • C� Addendum No. 96-3 July 24, 1996 Task Time of Order General Description _ _ Performance Compensation b . Addenda Coordination. The CONSULTANT shall receive and respond to questions from prospective bidders. Should it be determined that an addendum is required the CONSULTANT shall relay information relative to the necessary addendum to the Engineer of Record. c . Bid Opening. The CONSULTANT shall prepare a bid summary sheet and attend the Bid opening. d . Evaluation of Bidders. The CONSULTANT shall prepare the bid tabulation sheets and assist the CITY in the evaluation of bids, bidders and subcontractors. The CONSULTANT shall also assist the CITY in assembling the contract documents for execution and in awarding the construction contract. 2. Construction Administration 140 days $18,772 Services. The CONSULTANT shall provide the following construction administration services in connection with the project. Construction Meetings. The CONSULTANT shall schedule and attend a pre -construction meeting which shall include, but shall not be limited to, the CONSULTANT, the CITY, the Contractor, and the major Subcontractors. The pre -construction meeting shall review and discuss any applicable procedures for contract administration as well as any other items deemed appropriate by the CONSULTANT or the CITY. During construction, the CONSULTANT shall schedule additional meetings with the CITY, the Contractor, and others, when appropriate, to review the progress of the Project or as otherwise necessary to protect the interest of the CITY. The CONSULTANT shall prepare, distribute and maintain detailed minutes of the pre -construction meeting and all other meetings relating to the construction of the project. b . Review of Construction Schedules. The CONSULTANT shall examine and review all construction schedules, and updates thereof, submitted by any Contractor or supplier in connection with the construction of the Project. The CONSULTANT shall advise the CITY in writing with respect to the adequacy and accuracy of any such schedules or updates. 1p.tam.96-3 Page 5 of 10 Addendum No. 96-3 July 24, 1996 Task Time of Order General Description Performance Compensation 1p.tam.96-3 c . Shop Drawings and Submittals Review. The CONSULTANT shall review, study, and approve, or take other necessary action upon, the Contractor's Shop Drawings, product data, samples, and other submittals. Approval by the CONSULTANT of the Contractor's submittal shall constitute the CONSULTANT's representation to the CITY that such submittal is in conformance with the Construction Contract. Such action shall be taken with reasonable promptness so as to cause no delay to the Contractor or the Project. d . Approval of Request for Payment. The CONSULTANT shall determine amounts due to the Contractor under the Contract for Construction predicated upon inspections of the Work as provided by the CITY's inspector and daily log sheets, evaluation of the Contractor's rate of progress in light of the remaining Contract time and upon Page 6 of 10 ,e- 56—/ep5 Addendum No. 96-3 July 24, 1996 Task Time of Order General Description Performance Compensation evaluation of the Contractor's Request for Payment, and shall issue Approvals for Payment to the CITY in such amounts. The issuance of an Approval for Payment shall constitute a representation by the CONSULTANT to the CITY that the CONSULTANT has made an inspection of the Work as provided in Paragraph (c) herein above, and that the Work has progressed to the level indicated, that the quality of the Work meets or exceeds the requirements of the Contract for Construction, and that, to the best of the knowledge, information and informed belief of the CONSULTANT, the Contractor is entitled to payment of the amount approved. e . Inspection of the Work and Testing. The CONSULTANT shall carefully inspect the Work of the Contractor whenever or wherever appropriate including any final inspection or testing required by the Contract Documents. The purpose of such inspections shall be to determine the quality, quantity and progress of the Work in comparison with the requirements of the Contract for Construction. In making such inspections, the CONSULTANT shall exercise care to protect the CITY from defects or deficiencies in the Work, from unexcused delays in the Schedule and from overpayment to the Contractor. Following each such inspection the CONSULTANT shall Ip.tam.96-3 Page 7 of 10 Addendum No. 96-3 July 24, 1996 Task Time of Order General Description Performance_ Compensation submit a written report of such inspection, together with any appropriate comments or recommendations, to the CITY. Furthermore, the CONSULTANT shall require and review any and all tests required by laws, rules, regulations, ordinances, codes, orders or the Contract Documents and shall report in writing to the OWNER the results thereof. Day to day inspection shall be provided by a CITY inspector. The City inspector will maintain daily logs and notify the CONSULTANT when their attendance is required. f . Change Orders. The CONSULTANT shall review, and advise the CITY concerning a single proposal and request for Change Order from the Contractor. The CONSULTANT shall coordinate up to one Change Order for the CITY's approval and execution in accordance with the Construction Contract. g . Substantial Completion and Final Completion. The CONSULTANT, based upon an inspection of the Project, shall determine and certify in writing to the CITY the date of Substantial Completion of the Project and the date of Final Completion of the Project. When appropriate, the CONSULTANT shall issue a final Approval for Payment. Record Drawing Review. The CONSULTANT shall review any updated reproducable record drawings furnished by the Contractor or the surveyor hired by the Contractor and submit to the CITY that said drawings are adequate, accurate and complete. i . Submittal for Operational Permit. Ip.tam.96-4 Page 2 of 10 Addendum No. 96-4 July 24, 1996 City of Tamarac McNab Road 24-inch Water Main Task Schedule Task Time of Order General Description Performance Cam ensation Preamble This is a proposed 24-inch ductile iron water transmission main, to be located along McNab Road between 88th Avenue and 100th Avenue that will replace an existing 12-inch diameter asbestos cement pipe which ultimately must be taken out of service. The project also includes the rerouting of the Pump Station No. 25 force main. The purpose of this project is to increase water pressure and volume to new development in the western area of the City and conform to Broward County's requirements for the removal of the 12-inch asbestos pipe within the County's McNab Road widening project which is schedule for construction in early 1997. 1. Bidding Services 42 days $5,200 a. Solicitation of Bids. The CONSULTANT shall assist the CITY in advertising for and obtaining bids for each prime contract for construction and for any purchase of materials, equipment or services. Such assistance shall include the scheduling of pre -bid conferences and the attendance at same; the maintenance of a record of all prospective bidders to whom bidding documents have been issued; and the receipt and processing of payment for 0 bidding documents. The issuance of an Approval for Payment shall constitute a representation by the CONSULTANT to the CITY that the CONSULTANT has made an inspection of the Work as provided in Paragraph (c) herein above, and that the Work has progressed to the level indicated, that the quality of the Work meets or exceeds the requirements of 1p-mm.46-4 Page 6 of 10 C� • Addendum No. 96-4 July 24, 1996 Task Time of Order General Description Performance Compensation the Contract for Construction, and that, to the best of the knowledge, information and informed belief of the CONSULTANT, the Contractor is entitled to payment of the amount approved. e . Inspection of the Work and Testing. The CONSULTANT shall carefully inspect the Work of the Contractor whenever or wherever appropriate including any final inspection or testing required by the Contract Documents. The purpose of such inspections shall be to determine the quality, quantity and progress of the Work in comparison with the requirements of the Contract for Construction. In making such inspections, the CONSULTANT shall exercise care to protect the CITY from defects or deficiencies in the Work, from unexcused delays in the Schedule and from overpayment to the Contractor. Following each such inspection the CONSULTANT shall submit a written report of such inspection, together with any appropriate comments or recommen- dations, to the CITY. Furthermore, the CONSULTANT shall require and review any and all tests required by laws, rules, regulations, ordinances, codes, orders or the Contract Documents and shall report in writing to the OWNER the results thereof. Day to day inspection shall be provided by a CITY inspector. Change Orders. The CONSULTANT shall review, and advise the CITY concerning a single proposal and request for Change Orders from the Contractor. The CONSULTANT shall coordinate up to one Change Order for the CITY's approval and execution in accordance with the Construction Contract. g . Substantial Completion and Final Completion. The CONSULTANT, based upon an inspection of the Project, shall determine and certify in writing to the CITY the date of Substantial Completion of the Project and the date of Final Completion of the Project. When appropriate, the CONSULTANT shall issue a final Approval for Payment. The CONSULTANT shall also receive, compile, and forward to the CITY any and all written warranties, guarantees, bonds, certificates of inspection, tests, required approvals, operation manuals, maintenance manuals, and any other related documents required by the Contract Construction. The CONSULTANT shall review any updated reproducable record drawings furnished by the Contractor or the surveyor hired by the Contractor and submit to the CITY that said drawings are adequate, accurate and complete. i . Submittal for Operational Permit. The CONSULTANT shall convey the results of bacteriological testing along with the record drawings to the Broward County Public Health Unit to obtain the operational permit for the new water line. The CONSULTANT shall also coordinate with the Broward County Engineering Division and other impacted regulatory agencies to closeout the project.
