R 96- lq// A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE A ONE YEAR EXTENSION ON BID NUMBER 95-18 ENTITLED "FURNISH, DELIVER AND DISCHARGE OF QUICKLIME," ISSUED ON BEHALF OF THE BROWARD COUNTY COOPERATIVE TO CHEMICAL LIME COMPANY OF ALABAMA, INC- PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE WHEREAS, The City of Tamarac served as "lead agency" on the Broward County Cooperative bid for the purchase of Quicklime and twelve cities presently utilize this bid to purchase more than 30,000 tons of Quicklime; and WHEREAS, The City of Tamarac awarded Bid Number 95-18 on behalf of the Broward County Cooperative to Chemical Lime Company of Alabama Incorporated to furnish, deliver, and discharge quicklime for a one year period expiring October 31, 19961 and WHEREAS, The original bid provides a renewal term for two (2) additional one year extension periods at a vendor's cost not to exceed 5%; and WHEREAS, Chemical Lime Company of Alabama, Incorporated has agreed to a one year extension for quicklime at a cost of $96.96 per ton as set forth in the original bid proposal, which is a 2.5% increase; and WHEREAS, It is the recommendation of the Utilities Director and the Interim Purchasing Officer that the bid be extended for one year to Chemical Lime Company of Alabama, Incorporated; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to extend for one year Bid Number 95-18 entitled "Furnish, Deliver and Discharge Quicklime" to Chemical Lime Company of Alabama, Incorporated, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing 'WHEREAS' clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Temp Reso #7510 Section 2: Bid Number 95-18 for the purchase of Quicklime is extended for a one year period expiring on October 31, 1997 to Chemical Lime Company of Alabama, Incorporated. Section : Funding for this purchase has been recommended for appropriation in the FY 97 proposed budget. Section 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. In our previous conversation on July 12, 1998, you Indicated that there has been a transportation cost increase. Under Special Conditions #3, Pricing, renewal terms do allow for a request for an increase at the time of renewal based on Vendor's cost Increase not to exceed 5%. Awritten inquest must to submi ted to the Purchasing • Offraer for approval of any increase prior to renewal but no latter than Vendor's concurrence to renew, accompanied by Vendor's documentation to substantial# need for price increase - Please advise if a one-year extension with the allowance for freight increase as mentioned above, wovid be acceptable to your company.
