R-96-� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, REPEALING RESOLUTION 96-124 PROVIDING FOR THE VACATION OF A TWENTY-FIVE FOOT (25') DRAINAGE EASEMENT AND VACATING A FORTY-TWO FOOT (42') DRAINAGE EASEMENT IN ORDER TO FACILITATE DEVELOPMENT OF THE PROPERTY WITHIN THE INTERIOR OF A PORTION OF PARCEL "S", "KINGS POINT REPLAT", ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 156, PAGE 3 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; CASE NO. 4-P-96; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the drainage easement described in Exhibit "A" (attached hereto) was dedicated to the public on October 25,1991 at the time of the initial recordation of the Plat; and WHEREAS, the City Commission approved the vacation of a twenty-five foot (25') drainage easement at their regular meeting on May 22, 1996; and WHEREAS, the property owner, Lennar Homes, Inc., discovered that only twenty- five feet (25') of the recorded forty-two foot (42') drainage easement was vacated; and WHEREAS, it is now appropriate to repeal Resolution 96-124 which vacated a twenty-five foot (25" drainage easement; and Temp. Reso. #7519 2 August 28, 1996 Revision No. 1 - August 28, 1996 WHEREAS, the property owner, Lennar Homes, Inc., has requested the vacation of a forty-two foot (42') drainage easement in order to facilitate development of the property within the interior of a portion of Parcel "S", "Kings Point Replat", according to the Plat thereof, as recorded in Plat Book 156, Page 3 of the Public Records of Broward County, Florida; and WHEREAS, the City Engineer and franchised Utility Companies have been contacted and all have stated no objection to the vacation of the drainage easement; and WHEREAS, the Director of Community Development recommends approval of this request; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the vacation of a forty-two foot (42') drainage easement in order to facilitate the development of the property within the interior of a portion of Parcel "S", "Kings Point Replat". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 1 1 1-1 Temp. Reso. #7519 3 August 28, 1996 Revision No. 1 - August 28, 1996 SECTION 2 That Resolution 96-124, approved by the City Commission at their regular meeting on May 22, 1996, vacating a twenty-five foot (26) drainage easement is hereby repealed. SECTION- That the forty-two foot (42') drainage easement in order to facilitate development of the property within the interior of a portion of Parcel "S", "Kings Point Replat", according to the Plat thereof as recorded in Plat Book 156, Page 3, of the Public Records of Broward County, Florida; Case No. 4-P-96 (described in Exhibit "A"); is hereby vacated. SECTION 4: That the City Clerk is hereby authorized to record said document in the Public Records of Broward County, Florida. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6s If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. i] 1 SECTION 7: passage and adoption.
