R-96- Zu- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, PROVIDING FOR INSURANCE COVERAGE WITH THE FLORIDA LEAGUE OF CITIES FOR THE CITY'S PROPERTY AND CASUALTY INSURANCE PROGRAM AND FOR THE RENEWAL OF THE BOILER AND MACHINERY POLICY AND THE AD&D POLICY, EFFECTIVE OCTOBER 1, 1996, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property/casualty insurance policies listed on Exhibit A have an anniversary date of October 1, 1996; and WHEREAS, during this renewal period, quotes for lower self -insured retentions were requested from the City's incumbent carriers and from the Florida League of Cities for the City's liability programs; and WHEREAS, the quotes received were competitive in comparison to the premiums the City paid during the last renewal (at higher retention levels), however, the Florida League quoted an insurance program consisting of a $25,000 self -insured retention on General Liability, Auto Liability and Public Officials Liability; and WHEREAS, the Florida League will administer all of the City's liability claims and provide for full defense costs on the claims; and WHEREAS, the City will reduce its liability exposure by $75,000 per claim; reduce the premium it currently pays by approximately 3-36% per coverage, and only be responsible for judgements and settlements up to the $25,000 retention level; and Temp. Reso. # 7534 2 September 3, 1996 WHEREAS, the Florida League quoted a fully insured worker's compensation program; and WHEREAS, the Florida League will administer all of the City's worker's compensation claims, provide full defense costs, manage and provide for the care of the claimant and settle claims and judgements at the Leagues expense; and WHEREAS, the City will eliminate self -insured assessments to the State, third party administration fees, managed care fees, defense costs, actuarial reviews and recommended funding levels; and WHEREAS, the City's property insurance will be renewed with the Florida League with an increase in premium due to the increase in re -insurance treaties and the Leagues property exposure; and WHEREAS, the Fire Fighters AD&D policy and the Boiler and Machinery policy will be renewed through Arthur J. Gallagher with little or no increase to the City; and WHEREAS, after careful evaluation, it is the recommendation of the Risk Manager to approve the Florida League of Cities as the City's property/casualty insurer for the renewal of the City's insurance program, and to renew the AD&D and Boiler and Machinery policy with Arthur J. Gallagher; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the City's property/casualty insurance program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. Reso. # 7534 3 September 3, 1996 SECTION 2: The City Commission of the City of Tamarac, authorize the City's property/casualty insurance program listed on Exhibit B in accordance with the premiums listed on Exhibit B. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
