R-96--216 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A LIMITED WAIVER OF PARKING AND TO REDUCE THE MINIMUM PARKING SPACE WIDTH FROM TEN (10) FEET TO NINE (9) FEET AT UNIVERSITY HOSPITAL REQUESTED BY ROBERT S. COHN & ASSOCIATES, AGENT FOR UNIVERSITY HOSPITAL ON THE WEST SIDE OF UNIVERSITY DRIVE BETWEEN NW 72 STREET AND NW 76 STREET; PETITION NO. 15-Z-95; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the Tamarac City Code provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health and welfare of the citizens of the City; and WHEREAS, a hardship exists at the University Hospital located on the west side of University Drive between NW 72 Street and NW 76 Street; and WHEREAS, the Planning Commission has held a public hearing on October 18, 1995, thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development has thoroughly reviewed and 1 Temp. Reso. #7318 2 recommends approval of this application; and WHEREAS, the City Commission desires to take action on the limited parking waiver requested in the application by Robert S. Cohn & Associates, agent for University Hospital to waive two hundred twenty-nine (229) required parking spaces and to reduce the minimum parking space width from ten (10) feet to nine (9) feet based on the proposed square footage of the Conceptual Master Plan for the University Medical Campus (Exhibit "A" attached); and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the parking waiver. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: That the application by Robert S. Cohn & Associates, agent for University Hospital to waive two hundred twenty-nine (229) required parking spaces and to reduce the minimum parking space width from ten (10) feet to nine (9) feet at University Hospital based on the proposed square footage of the Conceptual Master Plan for the University Medical Campus (Exhibit "A" attached) located on the west side of University Drive between NW 72 Street and NW 76 Street, is HEREBY APPROVED, and such limited waiver would not be detrimental to the public safety, health and welfare of the citizens of the City All Resolutions or parts of Resolutions in conflict herewith are rj 1 1 Temp. Reso. #7318 3 hereby repealed to the extent of such conflict. SECTION I If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
